Dublin Airport Security

    reposting this in Aviation as no response in Legal,

    maybe someone here might have thoughts on this,

    Quick query, I travelled through Dublin Airport a few weeks back where security staff damaged my iPad (very large scratches on both sides) using their swab detector even though I told them to be careful. Requested compensation only for them to refuse saying they don’t know how it was damaged even though it was pretty obvious. What are my options?

    pretty annoyed as this is not the first time this has happened.

    Not the first time you've had an iPad scratched at airport security?

    I'm fascinated. I've been through airport security with my iPad at least 500 times and I've never had damage to my device. Not once, not ever.

    Not the first time I'm had electronics damaged whilst going through security, I never said another iPad, you assumed that. And good for you, 500 times wow. That must be a record. Your point?

    Was the screen and housing scratched or a removeavle cover for the ipad?

    the iPad was contained within a magic keyboard, when they ran their plastic swab tester over it, it left a deep scratch in the material. I wouldn't mind but I told the guy to be careful with it and treat it with a little respect and he completely ignored me. He then denied that he had caused the damage which infuriated me even more. The iPad itself is fine but those Apple Keyboards aint cheap.

    My point is that I find it hard to believe that security swabbing of electronics would cause damage except in the most exceptional of circumstances – and it'd pretty appalling luck for the same person to be impacted twice.

    I'm posted on here to ask what my options are, whether a random poster believes it is not my concern nor would I care whether you do or not. What I'm asking for is advice on how to proceed, not comments on how bad my luck is or isn't. Maybe I'm just that unlucky.

    What basis of claim do you have? Did you ask them to sequester the cotton swap and the plastic wand? If not I don’t see how you can expect to assert that they failed in their duty to you. If the damage was inadvertent and not because of a defective wand (can’t see cotton swab doing damage) then, other than goodwill on daa’s part, I don’t see you’ll get anywhere. You’d have had to kick up a fuss at the time to have any prospect of them entertaining a claim.

    I did "kick up a fuss at the time", I talked to a supervisor as soon as it happened and they took pictures of the damage and filed a report. They're now claiming it's not their fault when clearly it is and the damage didn't just appear there.

    And there is a duty of care to a passenger's personal equipment. I asked them to have some respect when doing their inspection. They did'nt.

    Can you prove that the damage did not already exist before the security swab took place?

    of course I can’t bloody prove it, I wasn’t exactly filming him when he was inspecting my stuff. So you’re saying because I can’t they’ve every right to wreck my property and get away with it? They acknowledged at the time the report was filled out that they had damaged it, now they’re saying they aren’t to blame. What sort of professionalism is that?

    I had white pudding swabbed at the airport and it didn't rip or tear open the packaging, I find it very hard to believe their swab could cause scratches/damage.

    I think the problem you've got is that you're trying to prove what is fundamentally a very unlikely situation that will boil down to your word against theirs. I'd say you're on a road to nowhere with that.

    Well however unlikely you believe it was, it happened and they admitted fault at the time it happened. Now they’ve completely done a U-turn and said it’s not their problem. In anyone’s book that smacks of pretty poor professionalism and customer service in my opinion. Guess I shouldn’t be surprised.

    Your question has been answered - small claims court. Let us know how you get on, rather than argue with people who think it's massively unlikely that it happened.

    Unless you can categorically prove that they damaged your possession(s) and they admit liability, you have ZERO chance of being re-imbursed anything, so i wouldn't waste your time or effort (Both here and anywhere else)

    Going by their stance, it seems you are at a dead end - FTR, Like the other poster, i travel back and forth UK several times a month with ipad, laptops, phones etc and not once has even so much as a scratch been caused and i actually can't understand or work out how a swab scanning machine could scratch the electronics, UNLESS it was done somewhat intentionally

    You said they didnt admit fault at the time though? You filled a report which a supervisor took and now theyre saying its not their issue.

    As argumentative as you want to be unless you can prove it wasnt there before hand, no many are going to believe a cotton pad did the damage you described.

    Could you contact the manufacturer of the case/keyboard? I would have thought their product should be able to undergo a swab test without getting scratched. You might have a faulty case. It might be worth your while to see if they will replace it?

    Its not the swap itself, it the wand thing the swab is attached to

    I work in IT and travel through frequently, and the laptop bag and laptop/ipad get a detailed swab from time to time - never had anything like this happen at all

    Rag order laptop with loose casing is exactly the type of thing that needs to be swabbed!

    There was no contract of service from daa to the passenger. I don’t think it falls within small claims procedure.

    It does. But the passive-agressive point I'm making is that the OP seems more intent on arguing with everyone that wonders how it happened (particularly as most people here are very frequent travellers and have not had this issue, whereas it has hapened the OP twice), than actually giving infornation on what he is doing to further his claim. I suppose if nothing else, they'll know what to expect when the claim is contested.
