    #MEGA MAKE EUROPE GREAT AGAIN

same link as above - breaking news

The judge has ruled Ms Hand has won her costs against Mr McGregor

The judge also ruled Ms Hand does not have to pay Mr Lawrence's costs.

The judge awarded her costs from the cowardly Rapist. And he has also ruled that Nikita doesn't have to pay the most virile Patsy in Ireland's costs. A good day.

    Proper and correct decision

And below opinion from judge so important

Both men had filed a joint defence and were “in lock step” with each other and the jury finding that Mr Lawrence had not assaulted Ms Hand must have arisen because the jury did not believe Mr Lawrence’s claim he had consensual sex with Ms Hand after Mr McGregor left the hotel, he said.

“He did not hold Ms Hand should have taken an action for conspiracy against Mr Lawrence. The case against Mr Lawrence failed because they concluded Mr Lawrence did not have sex with Ms Hand.

Mr Lawrence, under the relevant law, has been successful in defending his claim against Ms Hand but not for the reasons advanced in his defence, the judge said.

He had reservations whether Mr Lawrence should have been sued initially but Mr Lawrence and Mr McGregor provided a joint defence.”

Is the thinking here that McGregor + Lawrence made up a story about Lawrence having consensual sex with Nikita Hand after McGregor so it would cast doubt on McGregor raping her because that happened first? And obviously the jury didnt buy it...

    The Irish Times add:

The judge said he would leave over to another day whether to take any action against Mr McGregor over “highly irresponsible” social media posts.

The judge put a stay on all the orders until January 16th.

    Enjoy your Christmas mcgregor!

She gets 80% of the costs, which were over a million. She won't be left with much after paying the other 20% out of her 250k.

Is it not total costs were over 1m, I'd imagine her share would be less than 1/3rd of that

  • Registered Users, Registered Users 2 Posts: 11,767 ✭✭✭✭blade1

A go fund would sort that out in minutes I reckon.

I'd donate. Cover her legal costs with any balance going to the rape crisis centre.

I’m confused. The judge has said that Lawrence (well, mcgregor according to his own evidence) has to pay his own costs.

The judge also awarded full costs to her, meaning to my mind mcgregor has to pay them too

why are people talking about needing a go fund me?

She shouldn’t need to pay a penny from what I can understand.

    Or am I being thick?

Lawrence will pay his fees and she will pay her fees in relation to her claim against Lawrence.

Her fees for her claim against McGregor will be paid by McGregor.. she also will receive 250k award.

Her only costs are: The effect of the orders is that Ms Hand’s legal bill is confined to her own lawyers’s costs in dealing with her claims against Mr Lawrence.

    ah. Got ya. Thanks.

Wonder how they’ll divide that up?

Pretty relevant detail for a fair few on this thread. It was as much to catch out Lawrence in terms of why they went after him.

I don't think GoFundMe allows a fundraiser to be used for paying legal fees. Just as well he will be responsible for all his costs and those of James Lawrence. Hopefully her legal team will waive or reduce the amount due to them?

Spot on. She went to the hotel for one reason, well maybe two or three reasons. But sur shes completely innocent. Right……

Mod Edit: Warned for victim blaming

RW?(was one reason I never took it,anyway. My best mate at the time used to break up those vicks (sudafed?) nose unblockers and eat them)

  • Registered Users, Registered Users 2 Posts: 58,434 ✭✭✭✭walshb

yes, completely innocent to any half-decent human being. Of course, some toerags believe a woman cannot say no once they’ve gotten in any way intimate with a man. It’s his “right” to go as far as he wants..

This is what you’re excusing: He said the jury had concluded that Mr Lawrence did not have consensual sex with Ms Hand and that the men had concocted the story between themselves.

Did it do anything? The only time I've ever heard of that is in the book 'on the road' but that was back when they had some kind of strong amphetamine in them. I highly doubt that's been the case for many years. He was probably just eating menthol lol

on a separate point: aren’t legal fees fooking obscene in this country.. greed, it’s an awful trait.

  • Registered Users, Registered Users 2 Posts: 3,010 ✭✭✭McCrack

Highly unlikely her own legal team are going to charge her.

  • Registered Users, Registered Users 2 Posts: 4,196 ✭✭✭amandstu

I think it did (we did have that book around the place and he may well have read it)

It was the only time I suggested to him that he should stop doing that as his behaviour was quite alarming to me (strange gurning faces).

He ignored me and I lost touch so I don't know if it had a bad effect.

He was studying zoology and used to raid the botanic gardens as well (some of them were very common household plants (I kept on the grass).

Nah, solicitor fees, junior and senior counsel fees, case that took 6 years to work and build by a team of lawyers, various court applications during that 6 years, VAT included in the bill, medical experts report fees and attendance fees, 10 day trial in the High Court that was highly fought.

  • Registered Users, Registered Users 2 Posts: 42,418 ✭✭✭✭Boggles

    Why?

    The aren't SVP.

If there is a shortfall someone will have to pay.

  • Registered Users, Registered Users 2 Posts: 3,010 ✭✭✭McCrack

Costs were awarded on a party / party basis, her legal team will recover the majority of their fees and would not be necessary to seek any fees from Ms Hand.

  • Registered Users, Registered Users 2 Posts: 104 ✭✭Quango Unchained

I can't see how the jury awarded €250k if they fully believed Nikita Hand's account of the assault and also believed that Lawrence colluded with McGregor to fabricate his version of events. There is no sense in that.

Surely if they did believe that, they would have awarded "punitive" damages against McGregor and gone to town on him with the monetary figure. The jury probably hadn't a clue what to think but knew which way the wind was blowing in the country on this and didn't want to go back to their workplace having "not believed" Nikita with all of the campaigning going on around this.

Anyone who has only been following this through the media and is certain as to what has happened, they've lost all objectivity on this - it is just not possible to know with any degree of certainly what happened that day. A lot of groupthink going on. This is trial by social media.

How just is it for an extremely high profile individual to go through a public jury trial where the outcome is decided on the balance of probabilities for something so serious and highly charged as rape?

  • Registered Users, Registered Users 2 Posts: 58,434 ✭✭✭✭walshb

I get all this…of course it will cost….but I still think in general, legal/judicial fees are very high, and are prohibitive

This wasn't a no-win-no-fee, or free legal aid job. It was a gamble.

And 80% of the costs will be paid by McGregor. Any outstanding fees for witnesses, experts, reports, legal etc that were called by her side will be covered by her. It won't be a headline for obvious reasons, but she won't be walking away with anything close to the headline figure.

As someone said, she can setup a GoFund page and write a begging letter to cover the rest. They have pages for everything these days.
