.22LR Pistol License

    I have applied for a .22LR pistol three months ago and have not received any updates from my FO as to what is happening with the license.

    • I am a member of an authorised pistol shooting range.
    • The firearms I applied for is chambered in .22LR features a barrel that is exceeding 10cm in length and a magazine capacity of no more than 5 rounds.
    • I have been a firearms owner for over three years without issue.
    • Provided details of competence.
    • I have provided an extensive application with countless pages images of security, referenced the law etc.

    I have a few questions.

    • As my application has exceeded a period of 90 days where does this leave me?
    • Can Gardai add conditions to my application for no reason, I have heard of some people having conditions to their license and others have not What legal basis do they have to do this (Seems to be discriminatory as it is applied to some but not universal)
    • I have read previously about an "Approved list" of pistols although I never found this list. Can this be used as a reason for refusal.
    • The Commissioners guidelines mentions : "These pistols are different in appearance to and are unlikely to be confused with those designed for use by military/police forces" Can this be used as refusal if they "feel" like it?

    First thing you need to do is contact the FO, and find out the status of your application.

    It might be sitting on their desk, it might be sitting in the bin., it might be lost. All these have happened to numerus applications in the past.

    Then after you hear what the FO has to say it might be time then to ask them to get you an appointment with the Super.

    Notwithstanding the answer above, the law is very clear. If you have not received either a positive or negative response (with or without a written explanation) then your application is deemed to be refused.

    "Sect 3 (9) A decision on an application for a firearm certificate or its renewal shall be given within 3 months from the date on which the applicant submitted a completed application form."

    ………..Note the word SHALL not should or anything else……… (my edit)

    (10) Where the application is refused, the applicant shall be informed in writing of the refusal and the reason for it.

    [Appeal to District Court.

    15A.— (1) An appeal may be made to the District Court by a person aggrieved by any of the following decisions made by an issuing person:

    (a) to refuse to grant a firearms training certificate under section 2A of this Act;

    (b) to refuse to grant or renew a firearm certificate under section 3 of this Act;

    (2) An appeal shall be made within 30 days of receipt of notice of the decision concerned.

    15A.-(5) For the purposes of this section—

    (a) an issuing person—

    (i) who is required under section 3(9), 4A(7) or 10(4F) to decide on an application within a specified period, and

    *****(ii) who does not so decide,********

    is deemed to have decided to refuse to grant the application,

    (b) the applicant is deemed to have received notice of the decision on the expiration of that period, and

    (c) as the case may be, section 3(10) does not apply in relation to the application.

    As the law is written and 3 months has passed, your application is deemed to have been refused (whether you received notification of same or not) and you only have 30 days to appeal this decision to the district court, the 30 days starting on the day your 90 days runs out.

    The above is for your information, and it is up to you how you use it

    If you can do the job, do it. If you can't do the job, just teach it. If you really suck at it, just become a union executive or politician.

    Don't give up.

    I was waiting 7 months for my centrefire licence. In the end I phoned up and made an appointment to see the Super.

    In that time there had been 4 Supers and they just left the application on a desk. I got to meet the Super who said he was, sorry for the delay and will get it sorted ASAP, which he did.

    I missed the frist 6 weeks of the hunting season.
