No PP but stone cutting facility causing Noise Pollution of 100+ decibels daily

    Anyone had experience of District Court, seeking a cessation after years of Noise and Air Pollution. Stone cutting facility is un-licensed, doesn’t have planning permission and is 40 feet from our home, so we’re enduring 100+ dB of machinery noise, six days a week, 8am to 5 pm.
    Several enormous machines work daily, in addition to hand held angle-grinders causing chaos. Machines have reversing sirens, so they’re blaring from 8 am each day.

    Operators deny its a business and told Council its Hard Landscaping of the garden.. for years. Council refuse to take Enforcement.

    Do we have any rights?

    No experience but I’ve seen very positive outcomes in newspapers through the years - - had neighbour noise issues a few decades ago now and was about to head there when they sold up - record everything - dates times level of noise if you can and most importantly IMPACT on you and people in your house - package it all up and go to district court- it will be evaluated by the clerk I think first - but you don’t need a solicitor but obviously it could help - but…..no harm in writing to the people making the noise first outlining the impact on you - if they don’t cooperate (which I hope they don’t) then you’ll pretty much get a court ruling in your favour which will help you .

    Sounds like you have years of evidence already - legislation has tightened in this area in recent years is my understanding - don’t let the bastards literally grind you down - you’re entitled to peace in your home - good luck.
