    Anyone else get the feeling we’ve been had? The OP might be a dreamer?

    No reason not to post the ad. We all post dozens a day to various threads.

    I really want to know how, practically, he got his money back. Phone call and the garage agreed to take the car back and gave him cash or transferred the money straight away on return?

    Too many loose ends for me.

    At least I learned about that 30 day no fault return on goods. Didn’t know about that so not a complete loss of a thread.

    At least it wasn’t that new account dreamer who was popping up every month for a while with his fanciful stories of mechanics refusing to return cars and teenage neighbours mocking his driving skills!

    I say if this ever happens anyone else.

    1) Registered letter with proof of delivery and copy of the letter.

    2) Email to the company.

    At least you have proof.

    Sorry to push you on this but I think this thread could be a good source for people who find themselves in a similar situation.

    How did you get the refund? Email followed by a phone call? Registered letter? Did you use a solicitor? Did you just rock up to the garage? Did they give you a cheque, cash, do a bank transfer in front of you?

    How much pushback did they give you? It seems then went from fobbing you off to rolling over very quickly.

    You’ve shared an ad for a CHR privately with me but I’m not going to post it as I’m still not convinced that this is a genuine thread.

    Hi,

    What i did in a similar situation:


    Have proof of the fault, contact dealership, send email and registered letter. Quote the consumer protection act and that as this was a car purchased within 30 days you are not happy to keep this as the vehicle MUST be of a quality for which a similar value vehicle would expect.


    Obviously if you buy a car for 1K from a dealership knowing its a banger then dont expect a new car.

    this does not mean that if you buy a car off the forecourt and it breaks down you can just return / exchange it.

    dealer must be given a reasonable chance of repairing fault.

    No but it means where a car is sold with a serious fault, where it is crashed and not declared or where it was clocked (actually the time limit on these is much longer) you are entitled to demand a refund

    If you buy a car and the driving chain or belt goes within 30 days you are entitled to a refund.

    If the clutch goes you will probably only be entitled to a repair

    Great to see you got your money back OP. I also think you should post the advert up here. It might help someone else out and it's not like you're telling any porkies about it. You bought a crappy car and all you are doing is linking to the one you bought.

    Also could you tell us the process of how you got the refund after the dealer initially refused it?

    Yep I got it.

    Had a look at the photos. Looks respectable enough. All I could pick out in photos is a possibly poorly aligned passenger side front bumper to wing and loose plastic wheel arch.

    Up close could tell a tale though I'd say.

    Main dealers are not much better. Within the last five years I have had dealings with a BMW dealer (Approved used car) and was obliged to get on to BMW to force him to take it back. Two Toyota dealers in Galway and Monaghan attempted to sell respectively a crashed car (immaculate, sold and serviced by us) and a clocked car. Both cars were 'Toyota Approved Used'. When I contacted Toyota regarding the clocked car, I was told that I should contact the dealer directly. You couldn't make it up.

    I'd well believe a dealer would sell a lightly damaged car specially if it had good history in general. I would expect that the main dealer would at least put the money in to fix it properly pre sale.

    A Toyota main dealer selling a clocked Toyota is shocking. They really wouldn't have a leg to stand on and should be hauled through the courts even if bought in clocked..... if you managed to figure out it was clocked, they should be able to too. Being the approved dealer for the brand makes it a slam dunk.

    It's not a no-fault, it's if there's an issue with the item purchased.

    Thanks again everyone. I found this forum great, I read all your replies. Bought a car private yesterday. It's perfect. Only 19,000 klms. It's like new to drive. I bought another CHR. one owner, really nice lady. She put my mind at ease just talking to her on the phone. The situation with the garage has really changed my mind. Once you pay for a car, it can be a nightmare if things are not right. I think garages sell terrible cars and get away with it. The whole passenger side of the one I bought had been poorly repaired. The scary thing is how well the car looked, it took me a couple of weeks to figure out stuff.

    If I am buying a car again I will check so much more than I did. I would make a list of the things to check before buying. Bringing the car up to speed on a motorway is a good idea as well, going around the small roads beside the garage tells you nothing. The car checks online only show up what has been written down, milage, if they were taxis, or if any money is owed. A car can be crashed and repaired and you will never know. If no insurance was claimed it is not in the history.
