[Need Help] Last minute cancellation of Booked Property

I have paid deposit for a 4BHK house. I got a call from the real estate agent that there has been a confusion and the house we booked was really 3BHK, they cannot continue with the contract (I have paid the advance)

They have given me 2 options

1. Get an apartment that releases next for the same price however is will be delayed another 4 months

2. Place me on the list of cancellation waiting list

How to proceed in this case?

I don't understand what do you mean by booked a house? You mean booked a house for rent or paid deposit on a house that you will buy or exactly what do you mean by booked?

Talk to your solicitor to see what's in the contract you signed when placing the deposit. Developers usually have their asses covered in the contract.
