What is an Assignment

Hi there,

I went through the "Ground Rents Services" pages on prai dot ie to see what need to be done to buy the freehold on our house, but I'm unclear with one of the requirement they have. They require: "A photocopy of your Assignment". What does it look like, is the title of the document "Assignment" or could it be anything else?

I went through all the documents we got after completing our mortgage, but could not find something that was named Assignment.

Are you the first tenant of the council or did you buy it from someone who bought it from the council? If you are the first tenant you won'y have an assignment just a lease and the order transferring ownership.

The house was built on the 70s and has had a few owners before us. I do have a paper with the original lease agreement but nothing that I understand would be an "assignment". We also never received a request to pay the lease and the person listed in the folio to receive the lease is dead since a few years ... it seems.

Your purchase would have involved an assignment of the lease to you. There should be a deed between you and the person you bought from. That is the assignment.

Thank you for this. THe closest I found wast a paper titled "The Property Registration Authority" With the folio name, the transfer date, the name of old owner, our names, and it's signed and delivered as a deed at the end.

I'm guessing I'll have to find a solicitor to check this further. It's frustrating, I wish all this was a little simpler.

The PRA regard the transfer of a leasehold interest as an assignment. That document should be sufficient to show you are entitled to acquire the Fee Simple.
