Planning permission for 1 off HSE

    Hi All,

    Text below in italics is part of the reply I got from a a pre planning application.

    However when family farm was being transferred to me the dwelling house was also.

    With parents having full right of residence. was always looked on as their house anyway. It's an old house not really fit for purpose anymore. Its stuck in the

    middle of a farm yard not really practical to build on.

    At the time it seemed more straight forward from a legal pt. of view to do this way I believe.

    I work full time and part time farm, would not be a viable full time farm.

    One parent living in the house at the moment, has lost a lot of independence, can't drive any more, is dependent on me as other siblings 2.5 hours away,

    so I stay here now.

    Would like to build here, grew up here went to school here etc. spoke on the phone to planner , he said they are just going to work to the rules . He said this would be an issue, already owning a house. He advised that to put in a planning application costs a lot - does this mean its a waste of time I wonder?


    From the wording below transferring the house back would not work either.

    If anyone has any ideas of a work around please let me know.

    . The site is located in the Open Countryside as identified under the draft Development Plan. In ‘Open Countryside’ areas, the Council will consider single houses for persons where the development meets other relevant policies set out in the Plan, and where the proposed development is in accordance with all the criteria set out hereunder.

     

    ·       The proposed development must meet the normal planning and environmental criteria and development management standards,

    ·       The applicant does not, or has never owned a house in the open countryside,

    Ask around for a local Architect who has experience with the relevent county council and can advise. Also get a face to face pre planning meeting and bring questions / take notes. From those two meetings you should have an idea what's possible and what is not. One off houses are much more difficult to procure planning for. Read the County Development Plan to understand their terms of reference "Open Countryside" etc.

    You may be better off looking for a site/house somewhere in / near a village that is being redeveloped/ in need of renovation and get the grants (if any) for same. They will be targeting particular areas for this purpose in the County. Hope this helps!

    can one of your siblings apply under the local needs rule, then you simply take over their permission, as the planning is granted to the applicant "or members of the applicants immediate family"

    Can you look for a replacement house on another part of the farm. Maybe include a granny flat which could eventually form part of the house. You can claim the existing house is unfit for purpose.
