    Quite the opposite I would imagine. Theyre not going to risk somebody posting something that could be deemed prejudicial while a trial is in progress.

    Because he hasn't been charged... There is no court order in place preventing him being named. If and when he's charged, he'll be named.

    If and when he's charged, the matter will become sub judice, and this thread closed no doubt. So get your speculation out of the way now.

    OK. I get it. He has been arrested but not charged. So he can't be named until charged.

    What's in the media is what has been ok'd to release from the trial. That and nothing more.

    Speculation and discussion and opinion pieces around same is not.

    Anyhow you don't have to take my word for it, start discussing a case on boards that is sub judice in this jurisdiction and see how long you last.

    I'm not a legal expert, I agree. I suppose judgement was passed in cases like Brendan Mullin. It's all an education. Thanks. I'm not a person who will argue for the sake of it. I'll hold my hand up and say I don't have enough knowledge on this subject. I presumed and typed without thinking :)

    How sad for decent folk who looked up to this guy only to find out the ugly truth and be totally let down. I feel for those who thought he was a sporting hero and champion. A sad world.

    I feel sorry for genuine cancer patients who are just ordinary people, who don’t have the network or GAA fan boy club to tap for money, who are faced with having to raise unbelievable amounts for a chance at life. (I’ve posted before for a child in my extended family is over 300k for treatment abroad that the state won’t fund). It’s to those people he has done the most disservice, with people now more wary than ever of donating anything, even when the patients are real and staring down the barrel of death. If he has lied and scammed to raise money from a false cancer diagnosis, He’s a scumbag, and he deserves a harsh punishment and to be made an example of, and I’d include prison and community service in a hospice setting so that he can see every day how lucky he is not to be dying from cancer.

    Screamer I will PM you about making a contribution there. I agree with you but its not even people in extreme distress like your relative. Lots of people are in financial penury because of cancer treatment. They cant work or meet expenses and often rely on purple House to help.

    Reasons :

    The fact that the person has not been charged, boards.ie could be held responsible if defamatory information was published on their site and if a defamed person then decided to take legal action, or if action contrary to a court order (coverage restriction breech) was made by a poster, boards.ie would be implicated in the breech.

    Most people are not aware that if they as an individual publish or broadcast defamatory material, it is not them, but the platform that they used that will more than likely be sued, (website, newspaper, or radio/tv station) since the platform gave them wider scope to do more reputational damage to the individual, by providing a bigger audience to disseminate the information to.

    This is why when a caller to Joe Duffy on Liveline says something defamatory on air, RTE gets sued, not the individual that made the comments. The bigger damage is done by spreading the information to a wider audience. This is also why radio and tv stations and websites take out slander and libel insurance. They have to cover anything they might do themselves, as well as anything people using their platforms might do.

    Nothing will happen him anyway as these victims gave him the money willingly. Unless he has a stash of plants growing somewhere there is little prospect of any court or prison for him. Scammers are generally crafty enough to use scams that have little or no chance of legal repercussions.

    This is the current law on fraud

    Making gain or causing loss by deception.

    6.—(1) A person who dishonestly, with the intention of making a gain for himself or herself or another, or of causing loss to another, by any deception induces another to do or refrain from doing an act is guilty of an offence.

    (2) A person guilty of an offence under this section is liable on conviction on indictment to a fine or imprisonment for a term not exceeding 5 years or both.

    So if found guilty the punishment rages from a fine up to 5 years in prison. Provided those who got scammed continue to cooperate with the Gardai and are willing to give evidence against him in court about the fake cancer story then Id say he will be convicted. But we all know its going to be a suspended sentence if one at all.
