LPT Fraud ??

So, interesting story unfolding here.

I'm going about applying for a mortgage. Log into my revenue online account to get my EDS documents etc. and I notice on my EDS that there have been LPT deductions going back as far as 2013.

So, I've been paying LPT on a property I don't own since then. I was a tenant in said property and the tenancy ended in 2013. I remember this one in particular because the landlord tried to screw me out of the security deposit which I did eventually get back in the end. I don't know how I ended up being the one liable to pay LPT on a property I don't own and I'm not going to point any fingers.

I've paid a little over 5k LPT on that property at this stage. I opened up a case with revenue to fix this anyway.

Any advice on anything else I should do? Is there any legal recourse I can take to get all that money back?

I very rarely log into my revenue account.

Right now I have an "LPT 2022 Return" document in my revenue account. It states specifically that I'm liable to pay LPT on the stated property. That was the first alarm bell.

Then going to the LPT portal directly I can see that property listed there. Then looking at the payment history I can see transactions going back to 2013.

Then, finally, on my EDS I can see a line item saying "LPT Deducted" with a value matching the numbers I see in the transaction history in the LPT portal. So, all signs point towards me paying something I shouldn't be.

Furthermore, I don't own ANY property. I shouldn't be seeing LPT anywhere.

So the money is coming out of your bank account/credit card? Get on to the bank to report fraud

Have you checked the amounts against your bank statement to make sure it was definitely debited from your bank account?

I would imagine its been coming out of their salary via payroll deductions, which is what Revenue set for anyone who didn't give them details. Also, I think any bank would direct you back to Revenue rather than do a card chargeback anyway!

If the property was not registered to anyone, there were not entirely reliable methods to 'determine' the owner which may have caused it to be registered to the OP. A dodgy LL who wasn't asked for LPT would be unlikely to go and voluntarily ask why they weren't.

That looks like what has been happening. I've never set anything up with regards to this. I just noticed today because I needed to log into my revenue account and started digging.

Its a big chunk of money to be coming out in one go and not be noticed and surely Revenue cannot just haphazardly demand payment out of your wages without proof you are the owner

I was thinking more along the lines that the LL gave Revenue his bank details...

Revenue adjust your tax credits, its taken out evenly over the year. Comms are likely going by post to that house address and they are treating the same as a refusenik - they just charge.

It will show as a deduction on your payslips.

It's about 5k spread out of the past 10 years. Looking at my payslips now... I see ~50 quid deducted each month.

So you've not looked at your payslips in 5 years!

Id say it's your own fault but having spent a considerable period working in payroll I'm not surprised that you didn't look at them.

I'm no longer amazed at people's ineptitude.

It's not shown as a tax credit but as a deduction.

When LPT was introduced, Revenue sometimes had people who were renting the property listed as the liable party for LPT. Those people were advised to contact Revenue at the time to resolve it. Details of what's required is below. Once you've proved you aren't the liable person then you'll probably be refunded from 2018 onwards once your record is updated.

Agreed. 60 payslips provided and it hasn't been spotted. Can't imagine Revenue being sympathetic here.

Revenue aren't arseholes....they will refund the money and chase up the real owner for what is owed....

Ignorance is no excuse for Revenue. They'll resolve it but it won't be high on the priority list.

Their sympathy is not needed. He doesn’t own the property, he’s not liable for the charge. It’ll get corrected in a few days once the provides evidence or affidavit or whatever he doesn’t own the property.

Incorrect. LPT is separate (annual) value on the RPN, if is not an adjustment of Tax Credits or Bands. If coming out via Payroll it should be listed as a deduction from Net Pay on the OP payslip.

How did you not miss this €50 coming out of your account every month for 5 years. What else is coming out of your account that you do not know about. At this stage, I would suggest you go through your bank statements with a fine comb!

It didn't come out of their bank account. It was done at at a payroll level.
