car abandoned in our estate

Hi,

A car has been abandoned in our estate (12 months ago). I contacted DLR county council and they said that the road has not been transferred to them yet, so they cannot do anything. I emailed the builders and I'm awaiting their reply. Would anyone know if the car can be removed as it is in private land?

Might be worth trying the Gardai, if it is not taxed or insured, they could start issuing tickets on it.

Don't think the Council will touch anything on private land. There must be a management company who looks after other stuff on the estate - parking, lighting, grass cutting. Talk to them.

Yes, council already said they won't do anything. Let's see if the management company or buiilders are willing to do something. I will contact garda today. The car must belong to someone.

Tickets for not have tax or insurance. Fixed Charge Penalty Notices if you want to be formal about it.

The gardai should be able to contact the lat registered owner. More than likely it was purchased in a private sale and buyer took transfer of ownership to post and never did

'Public' in traffic law refers to places the public normally have access to, not to ownership.

Tickets for not having tax or insurance.

Same thing happened in our estate a few years ago. No one would do anything until one night the registration plates must have been blown off in the wind. Then the guards removed it pretty quick. Amazing how these things can happen 😉

anyway, my experience was that with a clearly abandoned car near my house (on a public road) the gardai weren't interested, but the council collected it quickly once there were no plates on it, so i don't know what your options are if the council aren't interested.

unless a local councillor can get it done as a favour.

The public have access to the private driveway in front of my house, but I do not need to have my car taxed or insured to legally park it there.

We had something similar in our estate. Car was abandoned for almost a week - making it difficult to go in and out of our driveway. I called the Gardai and explained I was concerned that the car might have been stolen and left there or something might have happened the owner. It was gone within 24 hours.

Technically the public have access to your bathroom every time you open your front door. That doesn't mean your going to allow them have a sh1t in your toilet without doing anything about it. 🙄🙄

The management company should arrange to have it removed. Ours does. I've never asked where they go after they're removed.

Similar happened to me a few years back. Car abandoned with some bags in the back.

Council wanted nothing to do with it. I was out for a run a few weeks later and just mentioned it to a Garda I was passing. By the time I finished the run and made it home the car was being towed

Bizarre comment; "public place" is defined for RTA as being a place where the public have acćess to drive whether for a fee or otherwise. It will generally include public carp parks and also developments/estates which do not have restrictions on access (e,g. gates or barriers or simple notices precluding access.).
