What are people cramming for Constitutional and cutting for Constitutional? I'm rolling the dice on independence of the judiciary, cabinet confidentiality and international relations for SOP. Covering Trial In Due Course of Law also. Then focusing on Referenda, AG/Pres/Interpretation/Natural Law, Freedom of Expression, Association, Assembly, Equality, Religion, Fair Procedures (Duty To Give Reasons), Right To Life of The Born and Refusal of Medical Treatment.

    Will that be enough?

Haven't fully narrowed it down yet, but from your list I'm leaving out international relations and religion and Trial in Due Course.
But I'm hoping I'll manage to do liberty, property & livelihood. I also have remedies.

A refusal of medical treatment Q would be so nice!

Edit: also don't forget to have one or two cases on standing, you can use it in almost any PQ

Does anyone have a summary of the Damache case???

The 2020 Damache case? It's basically just that the procedure for revocation of citizenship was unfair.
The Minister who initiated it also decided it, and was not bound by advice of independent committee.
So lack of independence. And also should have had high level FP since it was such a serious decision, with severe consequences

I am pretty similar except I have proportionality, access to the courts and property/livlihood added

left out right to refuse medical treatment/right of the unborn and I literally only have a few equality cases!

Also didn't bother with remedies and decs of unconstitutionality so hoping that doesnt come up hahah

If a case note on Zalewski v WRC came up would you also write about the Zalewski v Adjudication Officer case? (and visa versa)

I know they're different cases, but my understanding is Z v Adjudication officer is re standing to challenge WRC and then Z v WRC is the actual challenge, so they tie in together?

Yes, I am. They both came up as essay questions last time. I'm not expecting either to surface on this paper.

What about judicial power /admin of justice by courts . I hope it doesn’t come up Cos I can’t spot it in prob qs

    I hope you're right lol

I'll have a look just in case but hoping not to see them on the paper. The NDD case on the last paper was very tricky!

Potential essay Q on judicial power re sentencing - the City Colleges lecturer flagged Ellis case as very important both this sitting and last
I'd much rather it as an essay than a PQ though

From analysing the papers I wouldn't be surprised if we got an essay on constitutional interpretation - might be handy to have a case or two per heading just in case you had to do it. (I could be completely wrong)

Thank god the non delegation doctrine essay came up in March, I thought it was a horrible question. I just have a knowledge of it for a problem question or if a general SOP essay came up.

I think knowing the kerins v mcguinnes case is handy for a possible case note

For the sake of full disclosure, I am adding locus standi and the right to privacy to this. If this isn't enough, so help me.

I read over it earlier but my own hunch is one question on the independence of the judiciary (so like appointment, immunity from suit, dismissal and pay) and one question on international relations (particular emphasis here on an essay Q on Crotty and Pringle). Of course there is no way to know for certain.

Then I imagine: essay question on disputed result of a referendum; problem question on freedom of expression and company; problem question on freedom of religion and equality. Essay question on one of Pres/AG/constitutional interpretation/natural law. Problem question on trial in due course of law. Essay question on duty to give reasons (fair procedures).

If not the above - perhaps a question on the right to life of the unborn/the right to refuse medical treatment.

Yeah, that NDD problem destroyed me last sitting. Would have passed otherwise. I think Kerins v McGuinness is doubtful as a case note Q because it was pretty directly asked last paper. But I could be very wrong.

This is such a good shout. I agree - it threw me too in the one of the past papers. I have about 4 pages done out on it and I thought I’d be cutting it today but unfortunately I’m spending more time on it than say NDD at this stage!

I assume public administration of justice - Gilchrist? I am leaving it out as it came up as an essay last year.

yeah i think this and then just the fact justice has to be administered by a court (34) and then art 37 too for limited forms of justice? like Mcdonald v bord na gcon and zawelski v wrc

Ya I just mean admin of justice in relation to SOP like Sinn Fein finds case - Buckley AG then conclusive evidence, sentencing. Admin of justice of public came up last sitting so not really looking. At that

Anyone else so scared for constitutional? Like I have so much covered Cos I’m afraid of not being able to answer 5 qs but then I don’t feel like I’ll remember enough On any topic to write 5 good answers. Hoping examiner is an easy marker!!

I did it in March and thought the paper was a stinker. Missed out by 2 marks so here's hoping tomorrow is a bit nicer, last exam too :D

Keep reading the questions, you'll be able to find something for sure that you can incorporate!

I have such an irrational fear of the constitutional exam honestly it was somehow my best mark in college but im terrified of this exam! I find issue spotting hard in the problem questions for constitutional but not really for other subjects for some reason?? so im worried about misidentifying issues tomorrow. Hopefully it'll be a nice paper for us!
