    The parameters will be set by the law society, but I know people have failed Proctorio exams before because they read the answer aloud to themselves and it was flagged as cheating.

    can anyone clarify for me tests in vicarious liabilty city colleges and my manual seem to say scope test but then seemed to have mashed the scope'course together -

    would you say theres the course test, scope test and close connection test or

    is it just in the course/scope of employment as one test and close connection has the other more complex test for sexual assaults/child abuse/criminal acts?

    Quill prefers a mix of course and scope so you would look both at, was the harm done during the course of his work or was it in the parameters of the authority delegated to him by his employer (scope). Irish courts seem to prefer the scope test. An employer is generally not vicariously liable for criminal acts committed done by employees but there has been some successful cases.

    The close connection test is English I believe

    My personal take on it was a "simple test" for regular instances of a tort, and a "complex test" for more serious ones.

    Here is some recent English case law that might be worth a mention in the exam!

    Two significant decisions delivered by the UK Supreme Court in April 2020 will provide welcome relief to employers on the extent to which they can be held "vicariously liable" for the actions of employees or individuals acting under the employer's direction.

    In the cases of Barclays Bank plc v Various Claimants [2020] UKSC 13 and WM Morrison Supermarkets plc v Various Claimants [2020] UKSC 12 [2020] UKSC 12, the UK Supreme Court rowed back on an apparent widening of the doctrine of vicarious liability. The Court reversed previous findings that the relevant employer should be liable for the actions of individuals that were outside the employer's control.

    The UK Supreme Court concluded that Morrisons was not vicariously liable for a massive data breach committed by a rogue employee nor was Barclays Bank vicariously liable for sexual assaults allegedly committed by an independent contractor (a doctor conducting pre-employment medical assessments on behalf of Barclays).

    Could someone who is sitting Tort tomorrow answer a few logistical questions for me.

    - What exactly was the pre-exam process, was it the same as the mock ones where you 1. Showed your ID and 2. Showed your face smiling? Or was there an extra prompt to show your legislation and desk etc.?

    - Were you shown your score, or any potential flags on your sitting in regards to this proctoring software. The language around this, and the entire process, seems very vague and quite frankly sketchy.

    Thanks to anyone who could clarify what it was like to sit one of these "betterexaminations" exams. Best of luck to all

    I’m actually planning on logging on for the tort exam even though I’ve passed it just to see what the process is like - will post here after and let you all know!

    Hopefully LS doesn’t see this as me disregarding my pass and doing the exam again haha

    Sitting a few now and none have come up yet. First one isn't for a few days yet though.

    2. Preferential creditors - revenue, employees
    3. Secured Creditors - fixed charged over book debts, floating charges
    4. Unsecured creditors

    Is the above the correct order of priority?

    Hey folks, am I right in saying there is no requirement to enter a student number or any other personal details when taking these through betterexaminations. Just want to make sure I havent missed something in the correspondence from the law society.

    In Wicklow it took about 3 working days to arrive but I'm in the middle of nowhere. I ordered it on the Thursday and got it the next Tuesday morning.
