    Hey guys,
just a point of clarification. From what i can gather from this thread:
We cannot use rough paper to draft/plan,
We cannot go to the bathroom during the exam,
We will not have to give a walk around of the room before the exam but our eye movements will be monitored by proctorio software,
    invigilation will be automated,
We get an extra half hour,
i have done the mock and the system seems grand - bit of a nightmare not having a place to scribble rough work but it's better than waiting in purgatory like we had been0. i know how poor the Law Society have been over the last couple of months so i figured it was best to clear is up here - i've gone through a fair bit of the thread and couldn't find answers to everything.
i hope someone can help and that everyone is well!

Hey :) according to the FAQ section that the LS has posted we can take a bathroom break. More info on the link below which the LS said they will update this FAQ

I’m wondering how we are to show our surroundings if the invigilation is automated and there will be no one to ask us to do so?

I know someone that recently applied for the Executive Officer in the Civil Service Competition. When she sat the test they sent - it too was remotely invigilated - she was prompted twice in the 45 minutes to pick up the laptop and show the room and her workplace for 20 seconds while it recorded what she was showing!

Hey all - can anyone confirm if we can use the blue covered copy of the constitution being sold by legalbooks.ie for 10 euro, or if we have to get a copy from the OPW? I'm worried about delivery time for the OPW so looking at other options as back up.. Thank you!

I just briefly know it. I don't have a recollection of it coming up but I could be wrong. From the past exam papers that I've looked at though, I haven't seen it

    Thank you for this,
Would you talk about attempted murder if there is no reference to an attempt to kill in the question? It was my understanding that proof of intention to cause serious injury is not secure a conviction for attempted murder? Would you mention it and then say that there is no proof of intention to kill so a charge would not likely be successful?

Yeah on the one super vague sentence I gave there yeah there's definitely not enough, in a problem q the waters might be muddied. I just threw it in there so you can see how the DPP do it - not what's the most serious, but whats the most likely to stick. On a fact scenario like that I'd say the DPP would probably try assault and obstructing an officer of statistics. You'd probably need to know how bad the injuries were and what intentions the P had before you try the first two.

Give the most time to the ones that are most likely to get a prosecution and just note that the rest are more mere possiblities (particularly if information is missing - don't jump to conclusions often there is red herring information!). The DPP would rather have literally anything stick than risk a judge pointing out there's no intent to kill otherwise going into court is a waste of time. But yes good spot, I passed Criminal back in March this year and I've already forgotten the finer details.

I'd probably give it two lines - no attempted murder on what we know, but if information came out there was an intent to kill then that could be a charge brought.

    *****

Also I got offered the JA job so congrats to whoever was one below me on the panel :)

I'd say that'd be fine. I bought mine from Easons before and the LS accepted it when I gave that for inspection :)

I've been lucky enough to have time to cover enough so here's just my take on it:-
    - Agreement
    - Consideration
    - Promissory Estoppel
    - Exemption Clauses
    - Mistake
    - Misrepresentation
    - Terms
    - Remedies
    - Discharge
    - Undue Influence
    - Privity

I know a few people have been doing Capacity as well since it might be due a run but I've only schemed through it

The LS has apparently said that they're not monitoring our eye movements so hopefully it should be fine if you're looking down at the keyboard :)
Also the recording is stored for a while afterwards, so if they did have any suspicions they could watch over the tape and see that everything was fine

Hi - I know it is a massive course and hard to predict but I'm just wondering if people have any predictions for tort?

Also have the LS actually confirmed whether they will be tracking eye movements? I feel nervous that if I even take my eyes off the screen for a few seconds that it will make it look like Im cheating or something

Company law March 2020 Q7 - what topic?
Could anyone help me with what topics this is on? I thought restriction/disqual but the spring 2020 paper also has an essay question (q2) on that as well? Click the photo to view.

looks like involuntary strike off, consequences of strike off, grounds for strike off under s 726, say that it is possible in most instances to have a company restored to the register, I am not sure exactly how it is done I am going to bank on this not coming up again!!

Is restriction and disqualification an essential part of directors or could it be left out?
