What are people covering for Company? Don't have an up to date grid and trying to cut topics.

Are ppl covering ART 38.1 trial in due course of law?
Massive topic which does not appear to come up too frequent. Is there particular sub topics one should def cover?

I’d recommend doing it - once you break it down it’s actually grand and really easy to understand and remember compared to other Constitutional topics!

Is it worth covering defences in tort law? Doesn’t seem to come up too often and I’d love to leave it out!

Not doing case note question anyways.
I am wondering what people are focusing on for the general principles and competition law as it seems guaranteed but a huge topic ?

Hi does anyone have advice on law society fees? I don’t qualify for any grants, do firms pay for fees usually and pay you a wage?

  • Registered Users, Registered Users 2 Posts: 434 ✭✭rightytighty

    For tort I’m looking at

    All of negligence
    Trespass/Nuisance/Rylands
    Vicarious Liability
    Defective Products
    Damages
    Occupiers Liability
    Professional Neg
    Passing Off
    Limitation of Actions

Defamation was on the last two papers, and Employers liability on the last as far as I can make out, does anyone have any thoughts on this?

    Criminal - Sexual offences

Hey can anyone help/clarify the following for me?

The MR requirement for rape is subjective, i.e. the accused honestly believed the women was consenting so therefore lacks the requisite MR for rape.

But in the case of “consensual” intercourse by an adult with someone under the age of 15 this is an offence under section 2/section 16 of the 2006/2017 Acts and the test is whether they were reasonably mistaken as to the age of the child (on the balance of probabilities)? And consent is not a defence so is this also rape under section 4 of the 1981 Act?

The bigger firms usually do, with the smaller firms it depends. Often you might pay the fees and they pay you a wage. Do ask about paying the fees through the firm and reimbursing them if they're unwilling to foot the bill. The reason to do this is that firms can claim tax credits on the fees so the total amount isn't as much.

Would also really like some help on this - the topics are mostly okay but it seems really hard to identify the issues in the problem questions.

Does anyone have Constitutional notes for Judicial Review and/or Fair Procedures?

Can swap for any other notes or (fairly) recent exam papers or grids or anything just seriously struggling with these two topics and would owe you forever

I’m not doing Defamation, surely can’t come up again. Do you have a grid that includes October 2019?

Yes have tort grid but no equity grid!

    Equity

For injunctions do people think it's safe enough to focus on Mareva, know little on Anton Pillar, then focus on Mandatory Interloc Injunctions? I had a look through exam papers til 2016/2015 and they are they only ones that seem to have come up. If I have overlooked some questions please let me know :)

How far along the process are people? Is anyone learning off yet or generally still making notes?

I'm far from learning off, I moved on from Constitutional to Equity cause it was taking me way too long, must go back to Constitutional and do about 4 more topics. I'm really hoping Equity isn't too bad, seems alright so far. I only start learning off the week before the exam, has worked for me so far so hoping everything goes to plan. These are my last 2 so I'm really hoping I see the end of them at this sitting.

How are you set? When do you normally start learning off?

How long did it take people to hear back about getting passes carried forward under the new regulations? Emailed the form on Thursday but feeling more antsy the longer I ignore that subject (equity), just in case I have to sit it after all.

Ok that’s reassuring, I’m turning to my last 2 subjects now (EU and Tort) to try and learn them for 2 weeks and then I’ll start with Company and Criminal

Yeah I also applied, sent the form back two weeks ago Thursday, should we phone them?

I just got a reply a few minutes ago and my exemption has been granted!!

Would definitely email/call them to follow up as I only submitted my request last Thursday.

Also for anyone still wondering about timelines for responses mine took 4 working days (Thurs-Tues)

Thank you SO much to the people that posted about this here as I would have never found out otherwise and would have unnecessarily sat an extra exam

Unsure on this myself, as Mandatory Interloc Injunctions came up last time around im thinking about just going with Mareva and APO, but i'm unclear if you need to cover everything in order to be able to answer those topics fully. Any guidence from someone who's been through it would be great.

    Fellow at home studiers/sufferers -

How are you structuring your day? So far I’ve been ‘cramming’ in the mornings, looking at a second topic in the afternoon and doing a few papers in between. I’m fed up by the evening.

    Any advice?
