    Very interesting, thanks. Is there any difference between accidental and negligent in law, I wonder.

    If the driver drove in with smoke coming from the engine, are they negligent?

    I see Liberty have a cap of €30 million on liability to others with their policy.

    The depth of the underground car park at the NCH threw up all sorts of issues. I think there were also questions as to whether there had been properly spec’d fire suppression systems in the budget but no doubt they’ll be in the final plan. A hospital is one of those locations where standardised protocols for evacuation don’t work and the focus has to be put on systems to suppress the fire, including additional redundancies for failure.

    My experience is of a car that went of fire, damaged the car next to it.. and guess what...


    ..Each car owner had to claim off their own insurance.

    From the thread in the legal forum it looks like the car drivers insurance policy would be liable, but it could come down to other factors as well.

    I created that thread in an attempt to clarify if the Accidental Fires Act 1943 applied. From what some posters have said in repect of previous fires caused by an adjacent vehicle, it does.

    But everyone is running for cover and saying that the Zafira owner was guilty of negligence. In which case the act does not apply.

    But the Accidental Fires Act only applies in the case of a fire which happens 'in or on the building or land of another person'. So if your car was parked on a public street, the one beside you caught fire and your car was destroyed, the act would not apply.

    According to an article on independent.ie everyone claims off the Zafira owner and their insurance company may then sue Opel directly.

    It's going to be a huge claim

    The cars destroyed is small change

    It's the structural repair bill along with loss of profits for all the businesses shut that's going to run into millions

    Teslas are generally not spontaneously combusting though - people are just pointing them out because they are unusual cars or like a bit of EV scaremongering. The last high profile Tesla fire was as the result of a high-speed collision.

    Lots of ICE cars are catching fire all the time, just thankfully not so much in multi-storey car parks.

    I had a problem with some slight burning smell in my '98 Fiesta some years back, then one night a few days later smoke started emanating from somewhere in the cabin. I was near home so parked up and disconnected the battery, and got it towed the next day. Turns out the fan resistor pack had burnt up and the plastic assembly had melted - but I was turning up the fan to get rid of the smoke!
