Overtook an unmarked car today

    Hi, so I overtook an unmarked Garda car on the motorway and got stopped.

    I was told by the guard that I would receive a ticket for driving without due care and attention which is 2 points, but upon research, I’ve read that it’s actually classed as Careless Driving which is a mandatory court appearance and 5 points?

    He didn’t get a speed readout, but did tell me he recorded me overtaking him.

    What should I expect in this scenario? Court summons?

    3 points for speeding...
    They don't give a print out.

    He can state you were at X speed and that's it...

    I had a similar experience a few years ago and it was just the 2 points.


    Thought I had the letter still but I must have thrown it out. It definitely said "careless driving" or words to that effect. And it was only 2 points. Which I was happy enough with tbh as I was clearly speeding at the time as well which would have been 3 points :pac:

    Sounds like he plans to give you a fixed charge notice for driving without reasonable consideration, Section 51(a) of the road Traffic Act which is an €80 fine and 2 penalty points. I could be wrong of course.

    If I am right you won’t get a summons unless you don’t pay the fine within 56 days.

    They don't give a print out.

    They can’t, even if you are stopped with a gun they are obliged to show you the speed you were doing so I don’t how they could just say a speed sure how do they know their speedometer is accurate etc.

    Am I missing somthing but why should he stop you for over taking him? Are we banned for over taking on a motorway now!

    How long does it take for fine to come in the post. I got stopped by the gardai 4 weeks ago for speeding but never got a notice yet.

    Speed is far from the only factor in a dangerous overtake.


    Sometimes lack of speed is a factor in a dangerous or ill-judged overtake.

    What should I expect in this scenario? Court summons?

    Driving without reasonable consideration IS 2 Pts or 4 at court.
    Driver found to be driving carelessly is mandatory to court and 5 pts.

    They're two different sections of the RTA. Expect a FCPN in the post (2pts and a fine of €80).

    I think he does because he’s claiming the OP was speeding but has no proof except for being overtaken. The main question is what speed the guard was doing vs the OP? If guard traveling 110 and overtaken by a car at 120 it’s easily contested without an official reading.

    He is not claiming the driver is speeding, he is not giving him a ticket for speeding.
    The op said he was getting one for driving without due care & attention or without reasonable consideration of whatever it is.

    Generally they don’t have dealer stickers in rear window or reg plate surrounds either.

    Another one to look out for is the plain white Opel Combo van (current shape), there’s a few unmarked going around Dublin at least..

    I'll look out for a baby seat any time I'm overtaking a D reg Vectra/Focus/i40...be easier done than squinting at the windscreen looking for an insurance disc :p

    Yes but that’s still nonsense and all depends on speed vs speed. It’s not illegal to overtake slow moving vehicles on a motorway.

    That's all you have? Ah here, we all know that! They have tastier metal that is a lot less noticeable. Here in Limerick they have a Volvo S80 that is almost invisible. There is a Golf R floating around somewhere too.

    They hover around my area in a 2005 poverty spec Focus saloon also.... The biggest give away is the heads on the pair sitting in the front seats.:D

    Couple of 7/8 year old poverty spec Mondeo's also... stand out like a sore thumb... Still have a few old v6 Mondeo's in the collage in Templemore also i think, they have nothing done...

    I remember nearly 20 years ago they had a 1.4 energy engined Megane saloon down this way.... My god it was wrecked! it usually came into the workshop on a tow truck! It did'nt last long!

    Laguna, Punto in Dublin city until very recently, gold and 2000.... Old 2002 avensis, all sorts....

    Plenty of focii, Mondeo, fiesti still about....

    Love the estate Mondeo with twin exhaust but some gobsheens removed the alloys on selection so steelies on it....

    Use to love seeing the 2001 to 2007 mark 3 zetec s alloys on some of them about, looked smashing....

    They have golfs and not big standard, Mondeo and focus top spec, Skoda's, etc.... Haven't seen the Vectra OPC lately but it was ex Northern....

    We are well behind the UK when it comes to motors though...

    Remember a 2004 carolla in Dundrum chasing a pajero in black around ballinteer, they made sh1te of the car... It was never the lovely new sparkling squad car after that....
