Unlicensed security installers have been convicted Section 37 of Private Security Authority Act..

There's a clear difference between a "private security authority" and an "individual".

What about pretend CCTV, dummy cameras?

Probably falls under the Section 37 of Private Dummy Security Authority Act

Yes, because despite the "multiple quotes about statues" you are not classing yourself as a security entity. You just need to make sure your CCTV is not excessively/unnaturally capturing away from your property.

You mean you are just filming in your own home like a nanny cam? Only maybe in the garden?

Yes, but as you've quoted multiple times this is illegal...

    yes fine

Very common to have cameras in toilets. Generally viewing sink area and "walking" area. Don't show inside stalls and urinals it's all legal.

Next time you're in the toilets of a pub or McDonalds, look for a "smoke alarm" with black plastic in between actual "vents". Perfectly legal camera.

    Im right.

No you are not. You keep quoting people acting as a security installed/security entity/security personnel.

I agree 100% with you that security companies are heavily legislated. However, a person, acting as an individual, for personal purposes, does not fall under any of these statutes.

    no

Eh, yes you can. Anyone can install it for free, you can only party a registered installer to install a CCTV security system.

If CCTV is being used to monitor a non security process, anyone can install it.

For the third time: Can you show where LAs act as data controller for private commercial business?

I never said that. I said for cctv installed as part of a community scheme. And yes said community scheme can monitor private business. And they get it done for free that way.

But obv the pub is the data controller and its policy must be compliant.

The local authority undertakes role as data controller and all heightened obligations and caveats.

It has to be approved by guards and the local authority. They must act accordingly.

Things like dash cams can infringe privacy law. Because people with them are collecting data they become 'data controllers'. And as a data controller you have obligations and conduct etc.

Certain CCTV that is unverified by local authority may not be admissible in court. As it could be argued it has not been obtained fairly. So they are open to legal challenge.

    Same with dash cam stuff.

And yes there are lots of CCTVs without authority around the country.

There are certain community schemes at one point local authorities didn't want to act as data controllers for. So they had to be re-verified by a policing committee.

    You quoted it.

This was covered in the electrical forum last year.

Someone was insisting the it was illegal for an electrician or homeowner to install & maintaine electric gates to their property. After much debate it was established that if the gates were for security then only licensed installer can do it. However if they are not for security then anyone can install them.

I'm sure the same works for home CCTV. You could be keeping an eye on your dog in the garden. If the CCTV isn't for security then anyone can install it

OMG you guys in the other thread thought the other guy couldn't be a data controller ...because 'individuals can't be data controllers!'

    Yep.

The issue doesn't matter so much for gates. You won't have to use gates in court.

But then since the CCTV etc is usually just used to deter etc.

You are still a data controller though.

It could be a human rights violation for preventing you taking a piss in privacy.

I've just emailed Mary Robinson to get an answer on that.
