I have a Van that hasn't been taxed with over 12 months. It was insured but not used.

When I go to Tax it will I be required to pay the back tax, can I refuse to pay the back tax and just get it taxed for the following 12 months? And if I do state that I am not willing to pay the back tax can they legally refuse to tax my van?

Unless you declared it off the road you will have to pay back tax .. that is the law

I cannot find any reference to this in law, also is it possible to declare it off the road after the event?

Sell it to a friend and buy it back .

It must be declared off road prior to being off road.
You are liable for 10% of the annual tax per month it was untaxed.

I was going to sell it to my wife, get her to tax it then buy it back. Will this work?

Worked for my father in law. I'm surprised this has not been clamped down on in some manner. You will of course end up with two more owners on the Tax Cert though

Yes, this works and I can't believe it does. I've used this method twice to clear arrears on a car I owned.

Just know that you obviously push the number of owners up when you do this. If you're someone looking at the potential resale value of your car, this will have an affect on it.

It will work but would she/you be taxing it privately or commercially. If it's the latter you will have all sorts of hoops to jump through.

I'm not bothered about the number of owners as the van is getting on and its resale value isn't much.

Needs a Certificate of Road Worthiness too.

If you let it go over a year you will get a certificate valid for 6 months.

And if I get it done before the 12 months (say 11 months) wouldn't I only get a certificate for a few weeks?

Yes or even a few days.
