    Eir in 'unjustified' charges showdown

But, all quiet on the pole charge.

If there is to be a reduction in the cost of access it seems that it will be of eir's own volition according to this from Comreg commissioner Jeremy Godfrey:
AW: Will ComReg intervene in the standoff between Eir and Enet, which is complaining about the cost of accessing Eir's rural network infrastructure to make the state-sponsored National Broadband Plan work? Eir says this is a regulated price from ComReg.

JG: No, we set a maximum price that it is allowed to charge. Eir is perfectly entitled to charge a lower price than that maximum if they want.

We've made it very clear to them that if they choose to charge a lower price in the context of the NBP, that those are unique circumstances and that it wouldn't necessarily follow that they may then have to charge the same price to everybody else for much more limited access to poles in different circumstances.

So Eir actually has quite a bit of flexibility itself on this. But we're due to look at that pricing in the next year or so anyway. Sometimes the model assumptions change and the data changes and then the price changes. But it's unlikely to change for the next year.

There is also an explanation from him why eir is leaving copper in place for the time being while deploying FTTH.

So, the mooted legislation to cut access costs is just a threat to Eir to try to force them to negotiate a reduction.

That can't be for real the state has no way of doing that unless they feel like losing in the european courts?

It's all very confusing. Surely any legislation that cut costs would now be on shaky ground given that the regulator has not seen fit to intervene. Was it all a bluff?

The article is from January, before eir had pulled out.

I don't understand that. Isn't there already a price limit imposed via ComReg so why would reducing that price limit run afoul of Euro Law?

If legislation was part of the picture, it would have been published by now. I remember reading the number of poles involved @€;20 each but can't find it now. I did work out the implied sum at the time and it was huge. That may explain Eir's silence.

I, for one, am happy for the Govt to just pay through the nose and get it started.

I think it currently goes on the number of cables on the pole (or perhaps operator). So if one eir cable and one enet cable it's €10 each.

And the Government is internally planning a launch date of September 16 for the announcement of Enet as the winner of the state-backed competition.

Yeah can read it two ways.

    1. He’s happy Eir are cooperating and will come to an arrangement with Enet and gov can sign off.

    2. Eir are digging their heals in on costs to access their network and poor Denis knows Leo and the boys won’t cough up enough funds to cover governments share of costs..therefore Enet pulls out.

I’m kinda leaning towards number two just because I’ve completely lost faith in the department and goverment to deliver this after all the drop outs and delays.
    Hope I’m wrong!

And next he gets an email (or a few) pointing him at the fibrerollout.ie wholesale partner list, reminding him, that there are more providers, who offer FTTH on OpenEIRs platform.

And that he as a voted politician should be impartial.

AND !! that a lot of these other providers actually spend their money in Ireland :)

So that cheer lasts about 15 seconds.

    /M
