Regularization Fire Cert = DAC?

    Hi,

    Just thinking, if you apply for a regularisation fire safety certificate, do you need to apply for a DAC? No job involved here just wondering are people using this as a way of getting around lodging a commencement notice and a DAC... any thoughts

    Fire certs required since 1997, DACs since 2010..
    So they are not necessarily related.

    If you can prove the works took place prior to 2010 then you might be ok.
    Check with your BCO though.

    Reg fore cert doesn’t get you around the lodge meant if a commencement notice as if the works are significant enough to warrant a fsc then a completion cert under the BCAR would be required.

    Maybe my query is more on the policing of the system. Generally building insurance will look for a fire cert reference but not DAC reference. If a commencement notice is not lodged then a dac is not automatically required.

    Shouldn’t a regularisation Fire cert also envoke a DAC...but who checks this...

    Yes it’s enforced
    Your assigned Certifier will instruct the works as he/she cannot sign off on the works as compliant with the building regulations without it.

    Also, the council do cross checks to check fire certs against DAC’s and so forth.

    I understand the assigned certifier carries out this role when a commencement notice is lodged but there is no commencement notice/ assigned certifier for a regularisation cert. I believe this is a downfall in the regulations to allow a regularisation fire cert be granted without any cross check on the requirement for a DAC.

    I think you are right kcee.
    The Building Control Regulations Part IIIA has a FSCs for 7DN, Revised FSC and a Regularisation FSC.
    Part IIIB deals with DACs and there is no option for a Regularisation DAC.
    If it was me I would be to send in a DAC application if you were doing a Regularisation FSC anyway. Especially if you are signing off to Building Regulations. A DAC wont be expensive anyway, €500 when made in conjunction with a FSC application to the LA.
