Changing name by deed poll

    Hi all,

I've been wanting to change my surname by deed poll for years now as I wish to take my mothers maiden name, but I have a few things that are confusing me. I live in Ireland and I am an Irish citizen.

    First of all,
•Where can I buy legit deed paper where I don't have to pay huge money for a few sheets of paper?
•Can the witness who witnesses me signing the deed poll be a family member?
•Do you literally just print the template from the courts website straight onto the paper using an ordinary printer?
•How much will a solicitor cost for the signing and stamping of the deed poll?
•Will my passport (which is expired) be changed to the new name straight away when I renew the passport, once the deed poll is executed?
•Will I have to enrol the deed poll?
•I wish to apply for my theory test in September to start driving, will they accept a deed poll that hasn't been enrolled?

Thanks to anyone who can help me, I want to have my name changed before September for college so any help asap would be greatly appreciated, thank you.

I did mine in January, you can get sheets of paper in a place called Orca Stationery it is around the corner from the four courts, i would advise to buy at least four sheets as mistakes can be made, yes you can print from an ordinary printer make sure when you print the template you keep within the red lines to keep it legal, you can use a family member as a witness, i did, you can use a solicitor if you want they are more expensive, or use can use a person who is a commissioner of oaths which i did it costed me 10 euro, with regards to passport, you must be in use of your new name for two years, You can enroll it if you want its 60 euro i did'nt, as regards a driving licence they will only except it if it is enrolled, if you go into the NDLS site it will give you all the information

Thanks for the help. Once I get the deed poll signed and stamped by a commissioner of oaths/solicitor, is the deed poll recognised as usable? Or does it have to be approved? Thanks for the help.

I simply changed the surname on my passport from my father's to my mother's surname by going into a Garda station and getting a garda to sign a form saying it's me. I submitted this with my birth certificate which clearly stated my mother's surname next to my father's. Once I had my passport in that name, everything else was also changed and I became known by my mother's surname. It was not hard to do at all (this was 15 years ago).

Just a reminder, though, Ireland is a tiny society so it could be hard for you to do this successfully - unless you become a famous writer like Frank O'Connor (O'Connor being his mother's name; O'Donoghue being his father's) or Jonathan Rees Myers (Myers is his mam's, O'Keefe is his Dad's).

Unfortunately, you won't get the passport in the new name because of the deed poll as they don't accept deed polls. They ask for evidence of the new name being used.

So do I have to use the name for a certain number of years and then it can be changed, is that how it works?

Don't forget you'll need a public services card for your test now. I used work in DSP and it was two years usage required for name change to be accepted.

Yes, that's right; the rule is two years. You should still be able to change your name for most purposes, but, if travelling, book your flights in the name on the passport. That would be the best way of managing the situation for the time being.

Thanks for all the help I appreciate it. One last thing, it may sound stupid, but when you're printing onto the deed paper for example, your "Old name" and "new name", do you type it in the computer and then print it onto the template or hand write the info onto the paper once the template is printed onto it?

    Thank you.

Not sure to be honest. I am more familiar with the passports side of things, and I've changed my own passport name in the past, but I've no experience of deed polls.

    Perhaps a solicitor could answer?

No when you have downloaded the template onto the deed paper, you then go to
solicitor/commissioner of oaths, you and your witness will then hand write all the information as will the solicitor/commissioner of oaths and then he/she will stamp it

    Hi again,

Just a quick question before I go ahead with the name change. Do you think that it was worth changing your name for you or did it just cause too much confusion. Also how did you go about telling your friends about the name change.

    Thanks.

yes to me it was worth changing, if it is something you have wanted to do for a long time, do it, when you have it done just tell people, some will say okay others will say why, to which i would reply that's what it is, they will get use to it

    Hi again,

Today I tried to print the template from the courts website onto the deed paper but it didn't fit inside the red margins like it should. What should I do in this case as I don't want to alter the document as it may not be valid then. It was outside the red margin on the left hand side of the paper by about half an inch, and just didn't look right. Any help would be appreciated as I'm dying to get it done at this stage.

i actually did'nt do it myself i got someone else as i would'nt be computer savvy, i know it did take a bit of doing to get it right, use a blank page and mark where the lines should be from the deed paper print the template on to the blank page if the template in within the lines on the blank page just put it on top of the deed paper to see if it is right it might take a few goes, just keep printing it on to the blank page until you get it right before you use the deed paper, im sorry its the best way i can explain it to you
