Standby allowance laws

    Been googling and I can't find anything of use on this.

    I work one in seven on call. 24/7

    9-5 is my standard work day then cover the rest on call.

    At the moment we get nothing for being on call unless we actually get a call then we get a call out charge and 1.5 time. No standby allowance. Is there a law in Ireland that states you are entitled to be paid a standby allowance? I've been told it's illegal not to pay one.

    But I doubt that somehow

    I understood that one is entitled to be paid for 25% of the time one is on call. So in this case, it would be 16(?) hours x 25% = 4 hours.

    No entitlement in law. Depends on your work contract.

    This is what I was told also victor, but I'm not sure if that is standard rate of pay, or is it mandatory to actually pay it at all.

    I'm really not sure what is in my contract about it, I'm there quite a few years and haven't even got a copy, but I'm guessing it doesn't mention a standby fee at all.

    So I'm not sure where that leaves me

    Your contract should say you work x hours for x pay per week/month and should detail whether being on call is included in this pay amount.

    Sorry for dragging up an old thread but I've seen 25% being mentioned for standby payments - is this noted in any gov or citizens information type site/document?

    The Court also notes that the directive does not deal with the question of workers' remuneration, as that aspect falls outside the scope of the EU's competence. Thus, Member States may lay down in their national law that the remuneration of a worker during 'working time' differs from that of a worker in a 'rest period' and even to the point of not granting any remuneration during that period..
