Hi, can someone please enlighten me?

Can you be on PCB while your employer receives Wage Subsidy Scheme on your behalf.

Thanks, the reason that I am asking this is that about 10 years ago I was on IP (before PCB) and my employer was receiving WSS for almost 4 years. The Dept found out, told me I couldn't do that and ultimately I was let go. I wasn't aware that I was doing anything wrong. For a lot of the time since I have been trying to hold down job after job as I kept being let go.

I can't speak to the Rules 4 year's ago but my understanding is this.

If on Invalidity Pension, you must come off that payment & move to PCB first. I'm not aware there was any time limit for the WSS which I believe is supposed to be reviewed annually.

It would seem you have been misinformed & probably best contacting department directly.

Well with Invalidity, you are awarded on the basis that you're incapable of work so the Department would be correct that your employer should not benefit from this via WSS.

Invalidity Pension is a weekly payment to people who cannot work because of a long-term illness or disability

With Partial Capacity Benefit, you are permitted to work and retain a portion of your social welfare payment so that would be a different scenario, as Dempo rightly points out above.

You may qualify for Partial Capacity Benefit if your restriction on capacity for work is assessed as moderate, severe, or profound.

What section IP, PCB of WSS, which department are you suggesting I contact?

That's all fine. I will be returning to IP (email sent), then I will be looking for a job and telling perspective employers that I am likely to qualify for the WSS for their benefit.

Should be fine if you are receiving PCB. If you're getting Invalidity your employer won't get it as you aren't supposed to work while receiving it - see the excerpt from the link Dempo posted:

If you are getting Illness Benefit or the Invalidity Pension, you must come off these payments to start work. However, you may be able to transfer to Partial Capacity Benefit. This will require a medical assessment, but once you are approved, you will not need another medical assessment for WSS.

So if you've been approved for PCB then if you find new employment, transfer to PCB and once that is set up your employer will get WSS.

I'm in the process of transferring back to IP from PCB.

When I get a job I will change back to PCB and have my employer apply for the WSS.

You are reading far too much into this.

The Original Question, Asked & Answered. You Qualify by the mere fact you were on or can return to IP or if on DA.

As explained, you will then have to come back off IP to be considered for a position under the wage subsidy scheme.

This all said, my fear is if you are physically able to work, it make be not unreasonable for the Dept to ask, why you are IP.

The reason I am asking these questions is that citizens information and gov.ie both say that Partial Capacity is a qualifying payment. This has not always been the case. As I mentioned I was kicked off WSS 10 or so years ago, which I had been getting for almost 4 years, because I was told that my payment wasn't compatible with the WSS, I was on IP. Reason given, two payments from the same source.

There is also the issue that gov.ie website says that you are only eligible for WSS if your disability occurred within past one or two years.

My brain injury first occurred in 2007. I really don't know if I'm coming or going with this. The WSS would just opening up so many more opportunities for me and would offer an employer a much greater reason to hang on to me.

I understand that I'll have to come off PCB and return to IP. I have emailed the Dept to tell them to take me off PCB but got no acknowledgement of receipt. I'm concerned that when I get a job and return to PCB from IP I will be denied on some technicality and will ultimately lose my job as I did all those years ago while on IP and WSS.

Right now I am not sure that I can tell perspective employers that I may be eligible for WSS as there are too many inconsistencies is the Depts guidelines.

Work for me is and always will be rehabilitative. Without it I am likely to go into a state of cognitive decline, that is why my medical team are advising me to work.
