    HI. I am at the final stages of a planning permission approval and I will need to make the commencement notice when all the conditions are met. Planning has been granted and I am waiting for the architect to submit the answers for the conditions now.

    My problem is the architect. She has taken far too long to complete the work. I wonder if it is possible/acceptable to engage a different architect to submit the design drawings and supervise and certify the works once planning conditions are complied with. My stress levels are through the roof waiting on this lady to submit responses to the conditions etc.

    It is now a full year since the first planning permission was granted with the conditions.

    it would depend on the contract with your current architect but broadly speaking, yes

    Yes, you can use another profession for the construction stage. Whether that be an architect, building surveyor or engineer, depends on your requirements and that of the project.

    You mean it has taken your architect 1 year to submit compliance docs re planning conditions as granted. Not acceptable at all.

    Totally livid with the time wasting at this stage. Thanks everyone for words of advice on the architect. Yes from May 2024, I am waiting for her to submit new drawings with conditions. The outline of the roof was one of the issues so this required further drawings. There were other conditions and they did require time to draw them up again, but I thought the building work should have started in Autumn 2024. The paperwork/design in which all the conditions are addressed is ready for submission to the council since the start of Feb 2025, and they are not submitted yet, which means waiting at least another six weeks for a result. And if any of the conditions are not accepted, there will be further delays.

    If an architect/builder/engineer needs to submit a design plan when selecting the "with compliance" option for the commencement notice, I fear I will have a further time delay waiting for the architect to do her part of the commencement application.😖

    Can anyone advise me if it is unwise to select the "opt out " option for the commencement notice. What's the advantage of selection one or the other…"opt out" or "with compliance"?

    IIn My experience, opt out is used across the board for one off houses. That is why it exists.

    I do this stuff for a living and there are no issues with banks etc for mortgages that I have seen. That said, certainly in mayo, the opt out is requiring more and more detail at commencement stage.
