Can a shop change the price of a magazine while on the shelf and not remove it when new one appears?

    I buy a bi weekly magazine at a well known shop and new issue was out today but I asked a friend to buy it on my behalf. I was very surprised to find the shop has left the old one on the shelf and increased the price from €5.14 to €5.20.

    Is this legal?

    I must admit very disappointed.

    There are no regulations defining what a shop may charge for magazines.

    The only argument you might have is if they had a sticker on it for €5.14 but asked for €5.20 at the till.

    have a look at invitation to treat. linked below. Its a principle in contract law that applies here.

    to sum up goods on display in a shop are 'invitations to treat'. The store is inviting the customer to make an offer for the goods.

    to answer your specific question - perfectly legal.

    UK magazines have gone up slightly with the quarterly exchange rate system Newspread use.

    New exchange rates applied from 1st January. Many large stores simply upload a file to their till systems - the shelf tag might be delayed a day or so.

    But yes, they can do this. You have the option to refuse the transaction at the payment point.
