    You cannot sue an insurer, they have no part in this incident. Any action is against the homeowner. The function of the insurer is to indemnify the homeowner for his own damage and his legal obligation to others. As you have stated, insurers can refuse indemnity if the property has not been maintained, leaving the homeowner to compensate the car owner privately. In practical terms, insurers would not refuse a liability claim if the poor state of the roof was reasonably unknown to the homeowner.

    Isn’t this only beneficial if you stay with the same insurer on renewal?

    my friend works in a different company, and he said they'd take my full NCB into account as my bonus was protected, so maybe differs for some companies.

    Hi there I have similar issue as after last Storm my car where hit by roof tails causing damage I have to say that I’m renting this home which roof caus all the troubles now my landlord gave me all his insurance details but after contacting them I was send to my car insurance to sort it out using my insurance to do fixing of my car they also says that I can not use My Landlord Home Insurance cos im tenant and I’m contributing by renting it.The also told me if i would be a neighbour of this home than storey would be completely different as I would be able to use home insurance instead of mine can any one advise what to do ?Thanks in advance
