Car Insurance - Claim Query

    Hopefully this is the correct forum for this. We swiped the side of our car and need some work done to replace panels etc. we have gotten quotes and the cost is leading us towards claiming on insurance.

    However, for the other car we swiped we have already paid them cash to repair their car. If we proceed through insurance for our car, is there any issues with already having paid cash to the other party or will the insurance want to involve them also? I don’t want to query this with our insurance as then the event may be logged on our account etc even if we don’t claim.

    Any advice appreciated. Thanks

    When you paid off the other driver, did you get a signed receipt accepting the payment 'in full and final settlement'?

    Was there anyone else in the other car when you swiped it?

    Even for a minor scrape, your insurance may look at the incident as a possible personal injury claim, especially if there was a passenger in the car. Because the driver/owner of the car cannot sign away the rights of any passenger who happened to be sitting in the car at the time.

    It's never a good idea to pay off the other guy when you still don't know how much it's going to cost to fix your own car. You say you have quotes but some of the cowboy body shops have a habit of going in with a low quote and then discovering 'problems' with steering, suspension etc.

    If you mean to recover (from your insurer) the amount you paid in cash to the other party as part of a now wider claim that they are only hearing about now - they probably won’t make that easy for you.

    As per the poster above, you really need to have a full handle on any claim before you try to settle it, although I appreciate that is of little help to you now.
