Rate of pay

    Hi all, apologies of this isn't the appropriate forum but I have a query; I'm in the process of applying for a job & I've been shortlisted pending garda vetting etc.

    My question is about rates of pay, it involves shift work & weekend work which isn't a problem for me but the rates of pay are all the same rate no matter what day of the week I'd be rostered to work.

    For example, I work Monday & I get a set amount per hour & the same rate applies for a Sunday. Does Sunday attract a higher rate of pay or is it an an employers discretion? Any other job where I've worked Sunday (rostered or otherwise) has always had a higher rate of pay like time & a half, double time.

    Can anyone shed any light on this might cause me to reconsider this job.

    There is no specific legislation and pending any relevant collective agreement, you might not be entitled to any uplift.

    If there is a fair rotation on sunday work between everyone, the employeer might argue that any premium rate is baked into the pay rate, unless it's minimum wage, then that's difficult to argue.

    Forgot any sunday premium rate, assuming a fair dustribution of sunday working, is the package on offer reasonable ?

    I used to have a role with an occasional weekend rota for which we are paid "extra", but depending of how the weekends fell, some months I worked two weekends, others none (it was a one in five rotra) which causes the wage to vary each month. Eventually the employeer replaced this with a increase in basic pay which matched the "extra pay" for the previous year, which saved them a lot of paper work, and gave us a stable income.

    There is special provision afforded to Sunday working within the scope of the organisation of working time act, such as a premium payment or paid time off in lieu.

    However an employer is entitled to build in such a premium into the overall package. I.e they may offer an enhanced hourly rate of pay generally which they will say factors in the Sunday work.

    There is potential to challenge any such mechanism in the WRC where it doesn’t adequately remunerate when compared with collective agreements from associated industry for example.

    I imagine if you read your contract it will likely state the Sunday premium is a part of your salary already.
