Potholes in front of property

My property in an L road has a recessment area mandated by planning as is standard. Potholes have now formed along the line between my driveway/recessment area and the public road. We have reported these potholes to the council (it has gotten that bad) with their response being "these potholes have formed within your own front recessment area so therefore you need to have them repaired yourself."

I do feel this response is not right as the pothole have been formed as a result of the road use.

It looks like every other entrance in the country to me, where the hardcore meets the road. I agree with the council

That usually happens when it's just packed stone and constantly gets eroded especially when wet, you'd see mostly tarmac laid outside along the road of a private house now

I have the same at my entrance and like yours it's on my property so I patch them myself. I had potholes close to the entrance on the road and never had an issue with the council fixing them when I alerted them.

Councils operate on a who you know basis. Best get a few buckets of tarmac and fill the holes yourself
