Handing in notice on sick leave

    I’ve been on sick leave since May ‘23 and posted my letter of resignation yesterday (returning to college in September). I’m certified out of work until Aug 19, so my 2 weeks notice will end before my cert. I’m expecting my boss to refuse to pay the holidays I’ve accrued (she hasn’t a clue about workers rights 🙄), but I’ll fight her on it if she does.

    My question is; do you get paid for your 2 weeks notice on sick leave? I’m guessing you don’t, but someone told me I should…

    Genuine question - are you saying that you have been on sick leave for 14 months and you believe that you will be paid for the holidays that you would have accrued had you been in work for that time? I don’t know whether you are entitled to this by law but, if you are, it sounds absolutely nuts to me!

    Yes, annual leave continues to accrue while you are out on sick leave, and in addition your employer has to allow you to carry it over for up to 15 months after the end of the relevant leave year if you were unable to use it due to being out on long-term sick leave, and you must be paid for that accrued leave if you leave your job while still on sick leave.

    You'll be entitled to annual leave, yes, but I wouldn't imagine you'll be entitled to paid notice, as you're not available to work it.

    If you were and your employer told you not to, you'd be entitled to pay (gardening leave), but as you're not available to work, I don't believe you're due any notice pay.

    In this instance the company would have been within their rights to terminate you, but as it seems the case they didn’t you will be entitled to an annual leave accrued payment on your exit.

    re getting paid for your notice period when not working. LOL.

    Is it 15 months? I've just signed a contract (with a new company I'm about to start with) that states "leave not taken in any year may not be carried over into the next leave year"!!!

    If you are out sick you CANNOT take annual leave. If that’s the reason you have to be allowed carry it over.
