Planning permission for dbl extension

Hi

I have a question about planning permission for a double extension. I`m planning to get one on my terraced house and my neighbour has one already. The thing is his is on the boundary wall bordering with mine single-story extension. Obviously, it is against regulations as it should be 2 m away from the wall but since its there already I`d like to build next to him keeping me away by 2 m from another side neighbour's wall. Do I require planning permission in this case? Would the neighbour have a problem with legalising his if that is the case?

I`d say over 10 years now but not sure as I moved in 3 years ago.

The 2m rule is for exempted developments but there are other criteria such as window position and square footage.

First you need to work out if planning is required for what you want or if you can live with the exemptions and their restrictions.

Tour planning will have no bearing on your neighbors legal position so don’t worry about that.

Hi, thanks for that. I tick boxes of all other criteria to get exempted, so the real issue lies in this 2-meter rule...

If you follow the 2m rule then you’re ok.

Ignore what’s outside your boundary line. You need to be 2m away from both boundaries to be exempt.

If you build up close to his wall at first floor level then you will not be exempt.

Would it not be simplier to apply for planning and forego the exemptions and you will end up with an extension that is livable and not built piecemeal around exemptions for the sake of it??? Less hassle too if you ever try to sell on as all paperwork in place. It's actually not that scary either tbh.....

Single storey you can build side to side as exempt. Some are confused on the wording of this little nugget in the exemptions..

Don't know the site but from experience, building around exemptions, especially 2 storey to rear, can be harder to design a livable space.

Did your neighbour get planning permission?

Was there an agreement with the previous owner of your house allowing him to build on the boundary? (Your solicitor should have checked this during your purchase)

Yeah, the normal approach is that if there's an agreement in place for one neighbour to build along the boundary line, then it grants the other person (i.e. you) permission to use the wall for any future extension you might want to put up.

I also assume your neighbour has a sheer vertical wall with no drains or anything overhanging your side.
