Eflow legal standing

    Hi hoping someone can give me some legal advice. I recieved a penalty notice a few months back I haven't travelled the m50 in literally years its my reg on the letter. But the photo is clearly a different car make and different reg I ignored as I figured they could work out there own mistake by themselves. I have now recieved legal letters threatening court action. Could I sue for harassment. I presume I can't be done for anything if I don't bother to contact them. Any advise welcome

    Fair comment when the first letter came I had allot on my plate premature twins and just thought someone at eflow would spot the mistake and just drop it

    Because they, the operators are incompetent. But you, the pleb will suffer as a result of their incompetence. So it's just easier to accept that they can't do their job properly and contact them to advise them of the error in their ways.

    I wouldn’t even call them, fire an email off to them , stating it’s not your car in the photo and you were not on the M50 at the time. And leave it at that.

    Did you own a car with that registration in the past ?

    if so , did you follow the correct procedure for transfer of ownership / destruction of vehicle ?

    Well you can either call them and sort it out or sit it out and eventually end up in court which is a lot more hassle.

    Ring them, give reg, ask them to look it up on cartell, which will give car make, colour. Ask them to compare with photo and if they have sense, that's the end of it. Would be best if you could record that conversation for the purposes of a court in case they decide to hold firm. If they do hold firm, get yourself a solicitor. Don't ignore this, there are very big fines.

    They would have sent you about 10 letters before the court one. Why would you ignore 10 letters and increasing fines? If you had of just called them they would have cancelled it.

    Yeah these things tend to just snowball when they are ignored, just makes resolving it now more difficult unfortunately.

    Somebody made a simple mistake, which you spotted immediately. It would have been easy for you to query or correct, but you didn't, so they carried on acting on the basis of their own misunderstanding.

    At this stage you are not at risk of being found liable for the toll, penalties and costs, but if it gets to the point of a summons being issued, do not ignore it. Failing to respond to a summons is the same thing as offering no defence; there could easily be judgment against you in default of appearance and, really, you don't want that.

    A court is not going to be sympathetic to any complaint from you about "harassment". You could have stopped this very easily at any point, if it was bothering you; you chose not to.

    I figured they could work out there own mistake by themselves.

    They use an automated system. They send out letters. Lots of people ignore them. They are not going to individually investigate each one. They will automatically just send out the next letter and increase the fines until they either hear from you or it goes to a court summons.

    I presume I can't be done for anything if I don't bother to contact them.

    You presume wrong. Why would you not bother to contact them? They are one of the most reasonable companies to deal with with regards sorting out mistakes. A 2 minute phonecall will sort this out and avoid you getting a court summons. A judge mightn't look too favourably on you wasting court resources and times.

    FYI, if you move to a 'smart' meter electricity plan, you CAN'T move back to a non-smart plan.

    You don't have to take a 'smart' meter if you don't want one, opt-out is available.

    Buy drinks in 3L or bigger plastic bottles or glass bottles or cartons to avoid the DRS fee.

    If this is genuine, do you really think someone goes through every single reg and car that uses the M50 toll making sure that the car and reg match? It's automated and that's why you need to inform them.

    Fair point but a judge would neve see the OP as being the one wasting court time if it ever got that far, they've committed no offence bar being difficult.
