Fire Safety Cert for Individual apartment

    Hi, I am looking to buy an apartment in a block that was built in 1971. The current owner renovated it a couple of years ago. They insulated it and put it in an ensuite. my question is does this apartment need a fire safety cert? The block have a cert and is compliant? I was looking at the regs and an exempted property is (b) a building used as a dwelling other than a flat. Is an apartment in a purpose-built block classified as a flat or is that defined more as a typical pre-63 flat for example? All help is gratefully received. thanks

    Your apartment is a flat for building control purposes.

    The question you need to ask if there were any material alterations that took place that would mean a fire cert is required.

    If they only internally insulated it, and added an en-suite into an existing bedroom, I’d take a gut risk and say a FSC is not required but, you would have other regs such as Part F, ventilation of the en-suite.

    Hi Gumbo. They have a certicifcate of opinion of compliance which says all is in order but the report states 'a FSC should have been applied for but wasn't and as such I cannot confirm compliance with TGD B. Is this just to cover themselves or is it an actual requirement? My concern is how could a fire safety expert determine what work was done such as plastertboard etc when it is all finished. I just sold my apartment and didn't have this as an issue or was it raised by anyone

    Putting the wording “FSC should have been applied for but wasn't” is quite damaging to the seller.

    If I was the seller I’d be asking what works required the unit get a FSC.

    If you just sold your apartment, and had not Carrie do it any works then the block FSC would cover you.

    thanks, i have found your comments helpful. I will get my solicitor to ask for clarification on this and what grounds the report says a FSC is required and that the block one doesn't suffice
