Site with parking spaces

Hi all, I've bought a site that has parking spaces (the folio shows that the parking spaces are included in the site boundaries). Now, I'd like to reclaim part of these parking spaces to increase the size of the site.

Do you have any ideas about who should I ask for this proposal? If it's the county council, do you know which department should I contact?

If there is any planning permission covering the property you should look at that to see if the parking spaces are referenced.

In the first instance check the local authority planning section online.

How are you planning on reclaiming the boundaries? As they may affect the process.

If for example you are increasing a boundary wall to enclose the parking spaces, then you'd do that via a planning application or a section 5 declaration (exempt development).

Who do you want to reclaim the parking spaces from? Who currently occupies/uses them?

When I bought the site, I was told by my lawyer that the parking spaces were mine. Last week I had a pre-planning meeting and the officer told me that I need to investigate whether the parking spaces were mine or of the council.

The parking spaces are part of the adjacent development but are inside the boundaries of the site I bought.

I was going to reclaim the parking space through the planning application process as you suggested. It's just that I want to be sure who to ask before submitting the application.

The planning application for this site has expired since 2014. Could that still be valid?

Are the accessible to and used by the public, or does the occupier of the adjacent development control access/use? Are they on the street or accessed directly from the street? Are they maintained by the council? By the owner/occupier of the adjacent development?

Who actually parks there? If I came along, knowing nothing, would it look to me as if any road user could use them, or would I think they were parking attached to, and serving, the adjacent development?

They are on the street which brings to the development. When I went there, all the parking spaces included on my site were empty, same if I see the site from Google map, so I don't think they are used or maintained by the owner of the adjacent house, but at the same time, I am not sure. There is no signal on the street saying that those parking spaces are from the development beside or if you need to pay a ticket to park. Also no signal on the parking spaces themselves saying visitors or the number of the development beside.

In the folio there is a map with the boundaries circled in red including the parking spaces. Does this mean I am the owner?

Boundaries are normally shown in straight red lines unless of course they are actually circular. You might need to check the written entries in the folio to see if there are any burdens, easements etc registered.

If the parking space is your property, then the planning process is the process to ask. If you want to pre-check for issue you could request a pre planning meeting.

The expiration is the time to carry out the works. But conditions would apply in definitively.

Is your site part of a development with a number of sites ?

If so the parking spaces mentioned are probably part of the overall development planning permission conditions.

They may be provided to ensure there are enough spaces to avoid congestion on the roads in the development.
