Personally repossessing a car sold through a Dealer

    Hello,

    I sold my car through a used car dealer. We agreed what I wanted for the car and what he could sell it for. I left the car for him to sell.

    He sold the car to a customer 3 weeks ago and I am still pending full payment. He transferred some of the money from the sale, more than 50%. He is giving me excuses that the bank have held up the final payment. for two weeks now. I am starting to doubt this, and that he may be holding my money for some reason. He sold the car with a finance plan to the new owner so the funds would of been secured into his account.

    Does anyone know the legalities of someone personally repossessing a car if it is not paid for in full? Or is the law only on the side of a finance company? Any recommendations on how to proceed on this?

    Have you any written contract?

    How do you know he sold it with finance on it?

    is he a main dealer ?

    Did you transfer ownership ?

    Plenty of questions to be answered and a minefield. it happened my brother on a 5 series years ago and he only ever received about 50% of the cost after years.

    I honestly think you’d be throwing good money after bad going to a solicitor on this.

    Go to a printers. Get big signs made up. ‘Mr X sold my car two weeks ago and still hasn’t paid me €x that he owes me.’

    Put them inside your car. Park it across the entrance to his premises so nobody can get in.

    Walk up the road and wait for the call.

    ’Why yes, cash in the amount of €x will get me to move the car.

    If don’t block the footpath and it’s on private property, the guards can’t get involved either.

    A guy did it years ago in Annesly Williams out by the airport. They put repaired secondhand wheels on his brand new e class and refused to change them. He got a fairly quick response after months of being fobbed off. They got an article in the Indo for their trouble.

    Is the dealer a SIMI member. If he is then raise the problem with SIMI.
