New build - poor ground floor finish and no retaining wall

    Good evening, looking for advice/guidance on two issues we are facing with our new build house.

    The first is the ground floor concrete finish. Visually it's bumpy and cracked. Builder says it's within tolerances, flooring company (wood and tile) says it's way out of tolerances and have quoted €5k to get to a standard suitable for a floor to be laid. Has anyone come across this before?

    Second issue is, our house is on a sloping site, the house behind us is higher. We have a an earth bank at the bottom of our garden with a small wall and fence on top. There was a presumption the wall was retaining and dropped below the level of our garden, but now transpires the earth bank is the only retention , so we can't touch it (dig it away) without getting an engineer to sign off on works. Is this legal that no proper retaining wall.was installed?
