Accessing forestry via neighbour

Just wondering... Can you apply for a forestry grand road/pass that goes through someone else's field? . A neighbour said he's okay giving me a pass into my trees. I'm enquiring if I could have the new proposed pass constructed under the grant? Thanks

I would say that to build a grant aided road the Forest Service might look for proof of a legal Right of Way. But best to get the correct advice.

A legal right of way is easily enough created and maintained with the agreement of all parties.

This x 100. I have in laws in trouble here. They had a verbal right of way with a family. Father died. Sons not giving access. Messy.

Important that the right of way will allow you put in grant spec road and they understand what that means ie losing circa 4 metre passage way permanently to stone to allow trucks pass in and out.

If neighbor ok, yes. DAFM requires a solicitor drafted cast-iron ROW document.

Know of a case where 1k road granted with last 100m on neighbor who signed a paper stating so. Forest owner had issue with another neighbor and said his timber would be crossing that neighbors land to exit, claiming he had no legal right of way on the new €50k road. DAFM got involved, threatened to take his 50k plus interest back and that quietened him. They then introduced a new requiremebt for a professionally drafted ROW document for any such access issues.
