my Christmas tree lights have this switch that needs to be toggled on if the power is cut to it, so if you use a smart plug to turn the lights off it won’t come back on unless this switch is pressed regardless of power or not.

should I just cut it out and join the wire without it or is there any better way to work around it so I can use a smart plug ?

Have you looked at Switchbot ? If not cutting the wire and smart switch will work also
