Hi guys,

Just wondering if anyone has any experience of this. I’m a council tenant and recently our dad passed away leaving me and my siblings his house equally. If we were to sell the house to the council could I transfer to the house and rent our home place instead? We really don’t want to lose the house but I’m not in a position to buy the others out and they’re as much as entitled to their inheritance too. No hate please I’m very distraught over all of this 😢

Maybe I'm missing something but if you're a tenant you don't own the house and therefore have no legal right to sell it. Unless your old man owned it through a council mortgage, in which case he should have had life cover so no need to sell if you don't want to as the mortgage is covered

I suspect there are two houses here, although it wasn't the absolute clearest post.

1: The OPs council house

2: The fathers privately owned house.

There is no chance a council would agree to buy a house and transfer the OP to it, anyway. They don't buy every house they're offered; and they don't prioritise transfers except for actual need.

I don't think that's the way it will work, if you sell to the council I'm pretty sure they will offer the property to the next person on the housing list.

I don't think you can get HAP while renting a property from a sibling, the only option to retain the property is for one to buy the others out of their share. If the others don't need all their inheritance at once ye might be able to come to an agreement where you can live in the property and buy the others out over time.

My read is that the father owned the house. The OP is a current council tenant.

I suspect the answer is "maybe". I'd try contacting a local Councillor for advice.

Ah that does make a bit more sense

As you say it's unlikely that he will be able to sell the house and get his agreement transferred

But, have a word with a bank or Building Society, the OP doesn't mention how many siblings are involved but they might be looked on favorably to buy the house from the siblings. Say if there are 4 of them in total the OP would theoretically have a 25% deposit to buy the house

Yes I am a council tenant. My father owned his house which he left to me and my siblings! His house was bought and paid for nothing to do with council or council mortgage!

Without going into personal situations but there is actual need. My father did privately own his house. Two completely different houses too
