MHRV hasn't worked in 2.5 years and installer won't respond

Hi, looking for advice here. We installed a MHRV as part of our new build 5 years ago.

However, it's only worked for 2.5 years of that and I've spent the last 2.5 years chasing the installer to come back. He has come 3 times but never resolved the issue. At this point, he no longer answers the phone to me. I ring about once per month. We've built a fairly airtight, low energy house and without a working ventilation system, it all seems like a waste. I've rung the manufacturer in Lithuania and after a lot of back and forth, they said they couldn't deal with me directly and to work with an installer.

Does anyone have any advice on how to proceed? Is there any regulator or anyone i can report them to? I've tried other installers but no one wants to get involved. I really don't want to be facing into another winter of this.

What is your defects liability period under the contract?

Did you have a main contractor, or was is self build?

What is the contractors/installers warranty period?

What is the manufacturers warranty period?

Is there an advised service period, or agreement?

I understand that 2.5 years is not an acceptable lifespan for a mechanical system. But if you agreed to a 24month warranty, for example, it is not the installers problem. If 10 years, then obvious it's their problem. It's also not uncommon to labour to fall under a 12months defects liability period, and parts to fall under manufacturers warranty.

After 5 years its probably time to be serviced, at least that will determine what is not working. Which should help you determine who is responsible.

Thanks folks. Was hoping to avoid any legal option as I don't think the installer has done anything wrong. All the points that Mellor raises are valid and I'll look into them.

The main point is that he won't even answer my calls. And when he does, he tells he'll come next week or in the next couple of weeks. We'd happily pay the guy to fix it but that isn't even an option.
