How to Proceed… After hours building work

    Folks,

    not after legal advice, just general advice to mull over the best and most appropriate course of action in this situation…

    i have a close neighbour who let’s just say is not of the mind to be considerate or thinking of his neighbours. Never was.

    throughout the lockdown he has been having outdoor garden parties complete with sound system and multiple pissed up singing and screeching guests till about 2am in some instances. Yep, ‘that sort’

    This issue…NOW …he has been getting delivery of pallets of building materials over a number of weeks. He hasn’t applied for planning permission ( not sure if required ) but from tonight he has started building what I believe is a huge big wooden gazebo / sun house.

    as is his form not two fûcks are given as the construction… hammering and clanging only halted at 23.25, 20 minutes ago so… been absolutely consistent for hours… loads of neighbours are elderly and well, personally I’m just fed up of the inconsiderate **** and I’m wondering if there is any point in registering the complaint to the Gardai and what is the likelihood of them having time, interest and personnel to look into it….

    various government sources have different directions and advice regarding handling this which has left me scratching my head so I’m after any ‘experiences’ posters may have had as relates to this kind of behaviour….thanks

    First thing the anybody will ask is have you spoken to them and tried to resolve it yourself? So you know go knock on his door

    This is for cork county council, but likely wherever you are will have similar online resources

    long story short, you can check the planning permission online to see if anything has been registered (unlikely, as they would have to have posted up a sign outside their property indicating same).

    If it is illegal (and bear in mind, it may be exempt if small), then its to your local authority that you make the complaint to. The guards have no remit to get involved in this on.

    Thanks, no permission has been sought or granted. Won’t know if it’s required until it’s finished and can see it’s scale.

    Gardai will just tell you it's a civil matter and nothing to do with them.

    Call enforcement in your local authority and report it for both unauthorised development and outside normal working hours. It'll be a long battle anyway.

    No, and I won’t be doing , it’s a tactic that is available when dealing with reasonable people of which he isn’t.

    You can add 40 sq meters to your home with out planning and add25sq meters of "workshop shed....." with out planning. So your real problems is the noise. Like it or not ask to stop working at 9 and I'd say with the BH weekend he'll be at it all weekend. Chances are he'll be finished soon.

    You are asking somebody else to knock his door because you won't! Life's not like that, if you call a planning enforcement and say you asked him and he refused they might do something but if you don't we'll they might send him a letter eventually.

    Ya it's hard to tell here if this is a genuine complaint or if it's just a bit of NIMBYism (which we all suffer from at times)

    Since talking to them in person is out of the question you can go through contacting your local Planning Authority but as mentioned above, they won't just call out to him on a whim. It would take some time (unless they received multiple instant complaints/questions)

    Best port-of-call = knock on door and ask about keeping it down a bit at certain hours

    Other port-of-call = do as suggested above with reaching out to Planning Authority and waiting a while

    Other port-of-call = suck it up because it'll probably be finished soon anyway

    Other port-of-call = if you're genuinely worried about the Planning aspect of it; wait until it's done and contact Planning Authority then

    Honestly though, this will likely be a case of suck it up and deal with it (which is grim I know)

    You can add 40sqm to your home provided that it has not already been extended. If previously extended the total of all extensions (old plus new) allowed is up to 40 sqm. This does not apply to a listed building nor if it would breach any condition in a grant of planning permission. There must be 25sqm of garden left after extending and there can't be windows within 1m of any boundary. There are limits on the height of sheds and the uses to which they can be put.
