    Does anyone know can you draw state benefits if you are on income protection due to being off work because of illness?

    my guess-the income protection company have a policy of deducting state benefits from your income

    OP, slightly complicated, if you are ill and have been certified as being so , you should be claiming illness benefit. This is paid regardless if you are being paid by your employer.

    The same would apply if your paid via a policy.

    Some employers will deduct the illness benefit you receive Some may not.

    You don't state if your actual employer is paying you sick leave so I'm assuming they are not.

    So put simply apply for illness benefit, it's not means tested and is dependent on your contributions in 2020.

    I can't see you being entitled to other benefits if certified ill.

    Now the complicated part , you are technically supposed to apply for illness benefit within 6 weeks of being certified and your GP will have to submit a cert to DSP as part of the process , they may just do a new one and date it accordingly but that's a discussion you'll have to have with them.

    Thanks I’ve just recently been signed off sick my employer doesn’t pay me when I’m off so I’ve applied for my income protection but wasn’t sure if I could claim illness benefit also

    Morning, then absolutely apply for illness benefit and do it sooner rather than later , it is not means tested.

    Obviously I don't know the terms of your policy , wether the insurance company deduct any benefit you get , I know some policies that pay out income protection if you loose your job do deduct the net monthly payment to allow for a Jobseekers payment etc but your ill so not quite sure of your policies T&C's but regardless, your income from either a employee sick pay scheme or from another source is irrelevant with regard to illness benefit, so Apply ASAP , mindful of the requirement of a GP cert.

    Most GP surgeries have the form IB1 available and the Cert can be submitted electronically by your GP, they'llalso give you a copy. The GP assessment is free, cost covered by DSP .

    You'll need to post the IB1 form and I'd recommend you register it, I've seen a lot of cases where forms have gone missing in the post despite it being a Free Post government address.
