BCMS Question - Plans, calculations, specifications and particulars

    I submitted a new BCMS Notice using "Commencement Notice with Opt Out Declaration" and uploaded all the signed forms. I've an outdated Part L to fix but the other issue they came back with was I need to submit:

    "Plans, calculations, specifications and particulars as are necessary to outline how the proposed works or building will comply with the requirements of the Second Schedule to the Building Regulations relevant to the works or building concerned in accordance with the requirements of Article 9(1)(b) of the Building Control Regulations 1997 to 2014"

    I've uploaded a schedule of documents listed all the Architect's drawings but I've yet to appoint an assigned certifier who would look after this. Have I chosen the wrong BCMS option or can someone provide me examples of the documents they are looking for above? I need to see if the Architect provided them in the tender package or if it's something new I need to source? Just some titles and descriptions will do - that would be great, thanks!

    Edit: I think this just requires plan, section & elevation drawings on my part.

    Proposed Site Plan

    Elevation Drawing

    Section Drawing

    General arrangement drawing which includes plans/sections/elevations

    Part L Compliance report - getting this updated currently

    Deap Report - hopefully this hasn't changed over the last few years

    Schedule of documents - a list of all the Architects drawing documents from tender package

    did the "general arrangement drawings" contain a written specification?

    is there anything in the drawings which describes how youre going to build the dwelling?

    The General Arrangement Drawing didn't have written detail. That was what I uploaded first. But each of the other drawings I've since uploaded has a detailed outline specification at the bottom and the Section drawing has additional detail throughout. I think that's what you're pointing to and what BCMS was looking for? Thanks!

    As you are choosing a Opt Out Commencement Notice, you do not Require an Design Certifier and you do not require an Assigned Certifier.

    However you will need to retain a Qualified Construction Professional with P I Insurance to provide a Certificate of Compliance with the Building Regulations and Planning Permission.

    Opt Out Commencement Notice

    In opting out of the requirements for statutory certification of S.I. 9 of 2014, you are making the decision to not have a Design Certifier certify the design of the building, and you are making the decision to not have an Assigned Certifier inspect and oversee the works. In addition, you will not be able to register a Certificate of Compliance on Completion with your Local Authority.

    Anytime I have a query about an Application in relation to the BCMS documents, I phone the Fire and Building Control Dept, and they will tell me exactly what is required to complete the Application. They are always very helpful, and will inform you what you need to upload.

    You will need the Reference Nr of your Application in the BCMS, if you phone them.

    What is their number, I can't find it anywhere? They emailed me on Monday with:

    You are receiving the email reminding you of the requirement to comply with Section 3.1 of Technical Guidance Document M 2010 – Approach to dwellings.

    Also to upload revised DEAP calculations when you are in receipt of same.

    I've uploaded the DEAP calcs but am not sure about the Approach to Dwellings - they have the plans uploaded showing this already. I uploaded an updated Part L and hit resubmit. That was 2 days ago. 1 day ago I emailed them for an update. Heard nothing for the last two days.

    How long does it normally take to get an approval on the BCMS website?

    My status just says "submitted" currently. Validation Status is blank. Thanks.

    Rang my local council and got through to building control, their inspector is out on site so they will take a look when he gets back. Hopefully nothing big missing!

    Ok, so just got an email to say my commencement notice is valid and checked the BCMS website and it says:

    Status: Complete

    Validation Status: Valid

    Sorted!

    Just got a visit from Building Control same day checking I hadn't built the house or started any work already!!

    Anyway, all done for the moment with BCMS, thanks for all the help!

    Yes - email with attachment "NOTIFICATION OF ENTRY ONTO REGISTER – COMMENCEMENT NOTICE". Got the bill the following day too!! Thanks again for all the help!

    You dont "receive" a Commencement Notice. You lodge a "Commencement Notice".

    You do not receive a Commencement Notice until you upload all the correct data.

    No, that's incorrect.

    You upload the actual Commencement Notice as part of the data.

    The actual Statutory Document, the Commencement Notice is the form you download, sign and upload yourself.

    The BCA validate the Form and ancillary documents if required and issue a confirmation of placement of that Notice that you uploaded onto the Register.

    Unbelievable.

    You can upload hundreds of Commencement Notices together with thousands of documents, but you cannot commence until you receive a notice to commence from the BCMS.

    Maybe you can clarify…….

    The clue is in the name. You are lodging a commencement notice giving the BCA notice that you are commencing works.

    The BCA do not give you a CN, they validate and maintain a register of CN’s lodged.

    Section 2 - Role of the BCA

    ”Receive, validate and register Commencement Notices of the various types; with supporting documentation, without supporting documentation, or with the Opt Out Declaration”

    Section 1.5

    ”Building Owners, Designers, Builders and Assigned Certifiers are responsible for the notices”

    Hi,

    I have a couple of questions in relation to planning permission / fire certificate for a retail unit that's rented. I realise its nearly a year since some of you have posted and I am hoping that your still online as some of you posters seem to have in depth knowledge of this process.

    Basically, we have employed a different architect/fire officer as the previous person that carried this out for me has retired and I find my new one not as forthcoming with information.

    The background is that it’s a retail unit and planning permission was received in 2021 to make amendments to one completed in 2002. Planning permission was granted in 2021 and the issue is with obtaining the fire certificate (Article 13 I believe) as it’s so far taken over 18 months. So, I have a couple of questions if any could help, please, as I am now at the end of my wits with the current tenant speaking of ending the lease due to the delay.

    1. If planning permission is granted in 2021, then I am led to believe that there is 5 years period to make changes without the need to apply for another one? I don't know the correct terminology but is this correct?

    2. If planning permission is required again is this applied for through the NBCO (National Building Control & Market Surveillance Office) portal using the BCMS (Building Control Management System) section. Is this website used to submit both Planning Applications & Fire Certificate Application?

    Any help would be greatly appreciated at this stage.


    PS. Before someone highlights it, yes I have posted this in a couple of threads that relates to this process in order to try and find the right people that maybe able to assist.

    1. No. You must carry out the development in accordance with the plans and particulars as submitted in the planning application. If you need to make significant changes these, you need to apply for planning permission again.


    2. No, it's a different portal for planning permission as opposed to building control / fire certificate / disabled access certs etcb (although still under the localgov.ie umbrella)

    Thank you for your help. In relation to point 1, if there is additional planning required would it go under the same planning number as 2021 or be given a brand new number?

    And is there a way to check if there is any planning pending or lodged with a building you own if the Architect is in full control? I presume I would need to sign an approval or some kind of form to apply considering I am the owner?

    Apologised if these are very stupid question but I honest as so reliant on the previous Architect I am out of my depth here at the minute.

    1. No it would be a brand new application, therefore a brand new planning number.


    2. Yes you can check the website of the local authority you are in. You can check by map, or by address if it's specific. Note that if you are the owner, an application cannot be made by anyone else on the site without your written agreement.
