Friend bought a previously crashed car

Friend bought a car from a mechanic, all for cash and not sure what documentation he got. Ended up giving him horrid trouble and he brought it to another mechanic who told him that the car has been pieced together. He rang the fella he bought it off and said not to let the mechanic go near it, that he'd fix it. Friend got wise and brought it to a dealership who was able to tell him that the car had been wrote off previously.

Friend ended up taking the hit and taking scrappage for the car against something else but I'm wondering if there's anything he can do now legally or is it too late considering the car has gone to the dealership. Had he ever a chance of taking your man to the cleaners or was he screwed because if the cash in hand job?

First day law in UCC the lecture was " CAVEAT EMPTOR".....'the buyer alone is responsible for checking the quality and suitability of goods before a purchase is made".

Does the damage show up on a history report?

I'm not sure, it wasn't until he tried to trade it in after getting it fixed that the dealership told him that it was a write off. So there's obviously some system that had that noted.

That's fair enough. I wouldn't mind but a friend of mine was selling the same car for less, would have been a reliable sell and he said no, went a paid more for a write off.

did the first day in law school also absolve dodgy dealers from consequences, because, well, caveat emptor?

Google " CCPC crashed car". If the mechanic was trading in cars then it's possible he's acting as a dealer. Depending on the documentation he may have a case.

Competition and consumer protection commission deal with this type consumer crime.

    Probably nothing you can do.

Also there are different types of "write off"

If it was an "economic" write off, then most likely can be repaired and back on the road. This is where repairs are close to the value of the car.

Maybe so, but the legit dealership he went to wouldn't even take it as a trade in, only a scrappage over. I'm guessing it wasn't something they were happy to resell.

He probably doesn't have a hope but it sickens me knowing it happened to him, so said I'd look into it because he wouldn't.

If the car was safe to drive why doesn't he just drive it till the car is end of life. He/she wont get anything back and if it is safe and driving ok then spending thousands more to replace it seems like a double hit

Lots of cars will be written off because an air bag goes on them etc.

This is what the OP needs to consider. Was the 'mechanic' a dealer or was it a private purchase? If the latter, move on, lesson learned. If the former then you have comeback.

If it was me I'd drive it back to the mechanic dealer and park it across the entrance and start a confrontation and demand answers and a refund and not move it until a refund is forthcoming.

You should have stayed around for more than one day. You might have learned about additional rules pertaining to cars

I've done it before with a lemon of a Volvo S40 my mother bought in an independent dealer.

After multiple repair attempts had not solved the problem, we asked for refund. When it was refused I drove the car out there and parked it crossways in the gate of the premises and told the dealer man what we thought of him and his car in front of a few shocked customers. I left 20 minutes later with €5k in cash and no car.

Being a quiet little mouse gets you nowhere in this world.
