    HI,

Does a non paid director/company sectretary qualify for the small benifit voucher? Or would I have to put them on the books as an employee to do this? If anybody has a reference it would be great as I can't get any clarity from my googling!

    Chris

thats a good question but its a relief for employer to employee so in the case you have outlined above the company is neither the employer and the director is not an employee so then IMO they would not be entitled to the gift voucher tax free (this is just my opinion and i stand open to correction). If you google Part 05-01-01e then it will bring you to the tax guidance on this.

I thought the company was also entitled to a deduction for holders of office which would include a director, regardless of whether they were on the payroll.

Revenue make no comment about whether a director is paid or unpaid, so there is no issue. My wife is an unpaid director and she has received a €500 voucher each year under the scheme

I contacted revenue directly to ask them via ROS. They confirmed what you have said that the voucher under the small benifits expemtion is only available to employees. They actually got back to me within 24 hours once I contacted them, which was a pleasent surprise!
