    As for the main residence, I see what you are getting at, and you are going to be treating a very thin like. If you end up getting investigated by revenue then they will be the one's who will decide whether it is a main residence. They could interview your "licencees" and may satisfy themselves that you are not normally resident in the property and you'd getting a handy tax bill.

    I'd have students most likely, would be an apartment so 2 people max with high turnover.

    I know people who have done this for years and years and they've not even registered for rent a room and they have taken in over 14k a year.

    BTW I've house shared and taken in licensees for years and years and not once have I had one month non payment.

    Vast majority of people pay rent.

    Yes, not knocking the build quality. More the fact that the regulations nowadays wouldn’t allow for this scenario to play out.

    Nope, two different situations entirely. There doesn't need to be a lease agreement, the tenants are still protected by statute.

    You are considering all options but yet you seem to disregard the most sensible option and seem to fixate on build it by the seat of your pants route and, skirting the RTAs and tax dodges. OP, listen to yourself, you sound ridiculous.

    And as for them not being tenants if you don't have a lease, bills not in their name. Rubbish, utter rubbish. If there are agreed terms, even verbally, a lease or contract would exist by implication. Furthermore, after 6 months in-situ, the tenant aquires a Part 4 tenance, which, for the most part, supersedes most of what would be in a lease agreement save for house rules specific to the rental etc.

    Are they in Dublin ? As I doubt they would have got planning permission if were built in a back garden.

    You're committing fraud in that hypothetical scenario and leaving yourself wide open if things were to go sour. If you're not living there, it's not your principal residence. How is that so hard for you to understand? lol.

    If you're not living there + the people living in your property have the property to themselves, they pay rent every month 9 times out of 10 they'll be deemed tenants + accrue rights as provided for by statute. You will no longer qualify for rent a room relief + will be doomed to the wrath of Revenue.

    You might get away with all this for a while, but with your general attitude, you are running a high probability of running into disputes, and when disputes happen, they tend to end up in court. At that point it is not you who gets to dictate what does or does not qualify for this or that based on your own mental and legal gymnastics contrived to suit yourself. It will be the court/judge who will decide on those matters based on the circumstances and evidence they see before them, possibly brought by Revenue officers if is over tax matters. I guarantee you, if you are facing off against Revenue in the courtroom, you will loose. Both the case, and your shirt. And possibly one or both houses.

    Do you really want to go about this house project all the while looking over your shoulder and worrying when/if you are about to be brought up in an RTB dispute case or investigated by Revenue?
    By your general attitude here, I would say you have a higher than normal risk of running into a dispute and things deteriorating to the point of RTB and legal involvement.

    So apart from winding up the board, what are you actually more interested in? Building that house, or circumventing RTA and tax obligations?

    Normally I don't get personal on this, but jesus OP your house project idea is quite hairbrained and just will not work. Honestly, it is a fúcking stupid idea, especially when you have the means to get a mortgage.
    What builder or assigned certifier is going to waste their time pissing about with an on again off again project that drags on for a decade or more. And even if they did take it on, repeated mob-demob costs for the contractor would be ridiculous. No professional is going to stand over a project like that. It is just messing, and nothing more.

    And as for the whole rental and tax scam, well that is just what it would be. A fraud and a scam. And if you are caught doing it as you propose, you will get yourself royally fúcked over!

    Anyway, discussion of illegal proposals is banned on the forum and Boards.ie. So take your frankly retarded ideas and shove em where you appear to be speaking out of.

    This whole thread was me figuring out all my options.

    I rent currently.

    But one potential option was buy a 2nd hand place, live for few years, keep that as my PPR and have the rent income cover the mortgage.

    Meanwhile build a house without a mortgage as 2nd mortgage would have high interest rate and wouldn't afford it.

    I don't like being overleveraged. Being single paying 1k+ on a mortgage alone would be very risky for me in my eyes.

    Going back to original request, if you have a site and can throw 60k at it day one, you could go self build route if you would be able to put something like 30k per year at it. That would equate to spending 210k over 5 years.

    To be fair I know plenty of people who own apartments , and even logcabins and have them rented out and collect rent in cash . Mostly under 14k they dont put the money in there banks either credit union or just keep in there home. Probably because of revenue.

    Look at trades men always do cash in hand jobs, no way they are paying tax on it.

    Does anyone pay tax from selling there car , after making a good bit of profit from it ? Wouldn't say so.
