Seeking Info On Obtaining A Letter Of No Audit From Revenue

    Hey guys,

    I’m currently living abroad, and last week I finalised the sale of my home in Ireland. Estate agent and solicitor have gotten their cut, and the buyer has moved into the house. However, after it was finalised, my solicitor informed me that he would have to get a letter of no audit from the Revenue commissioners before he can release the funds to me. He wrote to them asking for it, and all taxes have been paid on the house and the CGT from the sale has been paid.

    We’re one week on and I haven’t heard anything. My solicitor seems to be allergic to giving me a timeframe on anything, and I can’t seem to find any information about this letter online, bar some
    minutes from a meeting of the Law Society a couple of years back.

    Does anyone have any experience with obtaining a letter like this? I’m just looking for a timeframe as I’ve agreed to purchase a home contingent on this sale, and the vagueness of the answers that my solicitor gives me are no help.

    It should take about 10 days to arrive. Generally revenue will issue this to your tax agent, generally accountant. But can issue to solicitor at times.

    Revenue seek to ensure that no prior taxes are outstanding, and no risk of a loss of tax in the current transaction

    The letter issues is a intention not to audit you.

    Hello, I'm in the same situation as you now..how long did it actually take to get that letter from revenue, and also did it have any impact on the final amount from the sale? Thanks in advance.

    Sorry to resurrect an old thread but we've just had our solicitor refuse to release funds unless they get a letter of no audit. I'm going to call them tomorrow but wanted to check whether my understanding of the need for it was correct. As far as I understand it (and recognizing that I am not a lawyer and I am not asking legal advice, I will talk to the solicitors when they open tomorrow)... We have moved to the USA and we've sold the house that was our home in Ireland. The sale completed on 8th October and we arrived in the US on 9th October. We were tax resident in Ireland when the sale completed. Our solicitor has only just realised now that there's a tax residency issue and the need for this letter, but we were tax resident when the sale completed. I think I want to argue that they don't actually need this letter, but I am not sure if that is a valid standpoint. We have relocated for work so Deloittes are doing our taxes this year, it wouldn't be the end of the world to ask them to do a CGT calculation, given no CGT is due but it will delay buying a house at this end. I was just wondering if there were any knowledgeable opinions out there?

    Resurecting old thread because pretty much the same scenarios as above. Any idea how long a letter of No Audit is taking these days in order that solicitor can release funds?
