Once you get issued your P60 you can request a P 21

Think I got mine early February but it's more up to the company ( there is a deadline imposed by revenue to have them issued). If you are contracting through an umbrella company or your accountant you might get it sooner if you ask them, if it's a contract position in the company it will be when they Do it. Dept of education for example don't get it done till march.

On the plus side the refund process is super fast online less than a week from start to money in your account

    Is this your first job?

If it's not all you need to do is ring Revenue and they'll sort out your tax credits for you and inform your employer and you'll get the tax back in your next pay.

You can apply anytime you like. Call revenue

Any time I got caught for emergency tax due to payroll being slow to process my credits they just paid it back over the subsequent months without me having to contact Revenue at all, did they not give you that option?

Far from it. I am contracting now since June and wasn't working before that in 2018 . I have an umbrella company since Auguest but have about 3 months of Emergency tax paid so would like to get that back .

If you are registered employed through a company that company will also need to submit your P60 (last year this will be necessary).

I rang them revenue twice this year trying to get it paid but it was never paid or sorted out. My payroll said revenue wouldn't pay it untill next year and I'm trying to get it paid as soon as possible.

Not this time of year. Although the OP should have got the benefit already if he passed his P45 to the umbrella company unless he was put on a Week 1 basis.

Log into revenue online in the new year, there should be an option for Form 21 then.

Not sure what week 1 basis means but I gave my P45 for my new job.
If I ring revenue now will they be able to get my back tax for my next payroll which is on the 7th?

Payroll wont refund emergency tax from a previous year.

If you are registered for MyAccount complete an eform 12 using your P60 or week 52 payslip as this will generate a P21 and any refund due will issue automatically.

Dont ring as youll be told to use the online service

Do you know what tax credits and basis you are on ?cumulative or week one?

I'd very much doubt any payroll will sort out issues for it to run on 7th Jan.

If youre registered for Income Tax Self Assessment you wont be able to get a P21. Youll have to file a Form 11 for 2018

From what you say it looks like your employer changed from them to the umbrella company before they could adjust based on your corrected credits, so they had no way of correcting your tax directly. If you had stayed under direct employment they could have credited the amount you overpaid against future PAYE.

    Hope you get sorted soon.

Form 21, end of year statement, should now be available to you in your online revenue account OP.

Yes, they'll stay empty until your P60 has been submitted to Revenue by your employer. This could take until february.

Thanks. I'm out of work and submitting illness benefit. Can I request a P60?

Sorry, I used the wrong term, it should be a P35 that the employer issues. They have until around 21st of February to file.

On ros now and I see the submit button for the End of year statement P21 but when I press it I get "We cannot process your request as you were registered for Income tax during 2018"

In form 12 it's status is available but when I press submit I get the same error.
Any idea what I should do?

What was your status with the umbrella company?

    Proprietary Director.

  • Closed Accounts Posts: 6,750 ✭✭✭Avatar MIA

    Proprietary Director.

    That's your issue.

You'll need to file a form 11 or form 12 return depending how much you were paid by that company.

I think they'll need to file their company accounts first. They have approx. 9 months from the end of their financial year. That's my understanding, but you might want to ring Revenue to confirm though.

    Proprietary Director.
If it is your company then it is up to you to file the p35. You can do this now. This will update revenue records and enable you to claim any overpaid paye

It's an umbrella company and he may have little actual control, but strange he's a proprietary director in that instance.

Umbrella Company directors are normally proprietary due to PRSI

You would have to file your p35 by the middle of February. Do you prepare your own wages using payroll software? If so create the p35 file within the software ard load it via the company’s ros

I assume as he is a proprietary director that he is contracting through his own company rather than through a third party company. He would not be a proprietary director otherwise

Some companies wont deal with non companies such as partnerships or Joe Bloggs & Son and sometimes the self employed will invoice through an Umbrella company. Re the proprietary director status - still confused on that as he'd need 15% ownership to be a PD, which doesn't make sense for an organisation offering Umbrella company services.

I understand how the umbrella company works. If he is using this structure and they have not sorted out his tax during the year then it would not appear to be working correctly At all.

This combined with the fact he states that he is a proprietary director would lead me to believe he has his own company set up

Actually, my fault. I thought the OP said he was working through an Umbrella company, but it was someone else.

OP, did you set up a limited company for this job?

If Revenue put them on a week 1 basis, then that could explain it. The problem could have been sorted months ago by asking Revenue to move them to cumulative.
