    The data protection and privacy laws of this land might disagree with you. Especially as he presumeably wants to use this footage to prosecute a crime which will involve a whole set of procedures as well in how the "evidence" was procured. I can see RTE Investigates having a case to answer for example on the case of the horse cruelty case.Just about every, single,rule of trespass, camera implantation, and evidence was broken.It's a textbook example of how NOT to do surveillance.

    The OP didnt specify if this was happening on a Coilte let or a private enclosed let of X hundred hectares.If it is Coilte,did he ask their permission to set up a trailcam for this purpose on their property..in writing? Did he put up sinage at the Coilte lets as to warn the GP that they might be filmed? How was this evidence transmitted to the OP?If it was sent by wireless,cell ,etc it does fall under DPA .

    Ask yourself this, if this was so simple as many county councils thought it would be to catch fly-tippers.Why has it never been used to prosecute many cases and only recently has been cleared,like this year to be finally legal for councils to use for fly tipping only in a public place?And let's not get into the technical problems of setting up a TC correctly to catch proper facial and vehicle number identification.

    Just for a point, I did 15 years of investigative surveillance work, and I am glad I am out of it as it has become a legal nightmare for evidence and procedure that can be challenged and dissected at courtroom level to see if it complies.

    Then after all this, hassle.you might find that the judge rules like one poacher a few years ago that the poacher was doing a public service as deer were according to the judge a menace to farmers and let him off with a wrist slap.
